The Credit Store ripoff Portland Oregon
Outright fraud by major credit card issuer .....
First Consumers National took over account from The Credit Store, which because of hard times I later had to default on until I could pay them off. They sold this debt to Midland Credit Management, who outright broke federal law in my dealings with them (FDCPA), in january I paid them off. It took 3 months for that to show on credit report, which at the same time I noticed that First Consumers had relisted it as an unpaid debt.
The way I see it is that FCNB no longer had any claim against me when the sold the debt, and by relisting it is committing fraud by claiming that money is still owed them.........

A good consumer lawyer would have fun with this!!
If FCNB "SOLD" the debt to Midland - then there is NO debt owed them by you!!
If you paid Midland - and you can prove it - you can sue FCNB for Fair Credit Reporting Act Violations.

The biggest question here is, do you have proof you paid Midland? If you do, then the other company can go screw themselves! What it sounds like is Midland hasn't bothered to report your payment to the original creditor. They may have just given the account back, never bothering to close it out, and the creditor has no idea you paid! Mail a letter of dispute to the original creditor, certified return receipt mail. Put the burden of proof back on them! Make them prove you DIDN'T pay! I hope you have proof you paid though because Midland is a son of a b***h!
