Complaint Review: The Hartford/Omni Insurance Company

On 7-6-04 I was hit by an insured of this company. First they wouldn't even talk to my insurance company (I have State Farm)- they wouldn't return phone calls, etc. But they kept sending me letters asking for my statement, which I refused to send them, they can get the info from my insurance company, that is afterall what I pay them for!

Only when my claim got sent to subrogation would they finally talk. This is when they started sending me letters requesting my complete medical records so that they could make a settlement.

I explained to the 1st of many adjusters (as well as the subsequent adjusters) that I still had approximately over $5,000 of medical bills remaining after my insurance had paid out $5,000 per my policy.

In a letter dated 10-19-2005,they have finally sent me their "settlement" offer. They are claiming 60% liability on the behalf of their insured. And holding me comparativly neglgent on the 40%. I NEVER AGREED TO THIS!

The offer of which one-half goes to my insurance company, who said they would accept the 60% and even refunded my deducticble, and the other one-half to me, but yet I still have more than that in outstanding medical bills.

Lets remember these facts:
My vehicle never touched hers, except where she hit me! She still swears she has no idea where I came from and is assuming I was going straight (which is impossible at the location of the accident). I even had time to swerve in an attempt to avoid the accident alltogether, but she never looked my way, just kept looking at the oncomming traffic light as she turned left right into me.

My vehicle was totaled! Mostly due to where she hit me, right on the Left (Driver's side) rear wheel, I mean smack dab in the middle, completely bending my tire in and causing damage to all the metal around it, not to mention the hatchback was now screwed up.

At the time of the accident my child was just 2 years old (and luckily not in the car) and our physician had suggested we have him evaluated for hearing and behavior style issues. Well thanks to this idiot, I no longer had a car, the only way I was able to keep my job is because the company I work for is awesome and has been extremly flexible.

Insurance companies like this one, have no business insuring "kids" who are in a big hurry to go nowhere and then treating the person they hit and who's lives they ruined like they were somewhat responsible for the accident.

I will be calling a lawyer, I know I can win this. I may not end up with any money, but at the very least my bills should be paid by them not me!

The settlement they are offering is a slap in the face to hard working people everywhere. She hits me, after trying to beat traffic, and I am now left paying the remainder of the medical bills, don't even get me started on what this has cost my child, or my health & well being!
