Someone "really" needs to do something about this company!!!

I was employed by Home Depot in 2000, and had to comute 87 miles one way to get to work 5 days a week. I was considered to be one of their most dedicated, and devoted employee's. I had always came to work on time, had repeatly made great reviews, and was
promoted to a racetrack manager!

As a racetrack manager I was able to make schedules for some of the associates, and decide what days of the week I wanted to be my off days. That decision was easy because for over 3 years I'd always had Monday's and Tuesday's off.

Following an accident that I'd had on the job which injured my wrist, I was called in the office by A higher manager that insisted I give-up my current position for a lower one. I was told that they needed me in another department. I refused to accept the other position, because I'd work so hard at getting the racetrack manager's one.

For several weeks I was seeing Home Depot's company doctor, and was finally dismissed. He concluded that I would have a lifetime medical, as long as I stayed in California.

I decided I needed to hire an attorney, just in case my wrist never gets well, and just as a precaution. To my surprise, after seeing my attorney for the first time and going to work. I was fired the same day!

I was completely devastated!!! I was called into the office by the manager that I'd previously seen and the human resource manager. They lied and said I was not supposed to be off on Monday and Tuesday. They said there was a posted schedule for me to follow, and I did'nt follow that schedule. Finally,they insisted that I missed 2 days no call and no show, and that was grounds for termination.

I feel that this action was taken due to my injury on the job, and it is difficult for me to fathom how such exemplary performance could be overlooked with a blink of an eye!!!

Home Depot is not at all the company most people belive it to be!!!

Mary,

I am sorry to hear about your injury, but if you did see an attorney then he should have told you that your job is protected by California State Law when you are hurt on the job.

I have recently gone through a similar situation and did quite a lot of research at that time.

1. If you have not yet done so you must file a Workman's Comp Claim with your employer. As long as you were injured on the job they cannot refuse you to file a claim.

2. You should find out who the company's doctor is for Workman's Comp claims, and go see them. If they refuse to give you this information, then you must see your attorney and he will take care of everything for you.

3. Your employer MUST retain you as an employee on medical leave and MUST return you to your job classification at the end of your medical leave that you were at at the time you were injured.

4. State Law guarantees you this protection for up to six months from your date of injury. Only after six months can the employer refuse to take you back at your previous classifacation.

5. ALL EMPLOYERS are required to post on a bulliten board the state-mandated rules pertaining to on the job injuries, and also post the location where an employee is to go for medical help when injured on the job.

These are just the basics, and I am really surprised that your attorney has not explained these items to you.

If after attempting the above, if you are unsuccessfull, then your employer leaves himself open for punitive damages down the road in addition to those damages which the state provides for on the job injuries.
