We are reporting on The Jessica Hargis Realty company for failing to disclose material facts and making false statements/assurances regarding the home ((((REDACTED))) Halifax St, Roanoke, TX (((REDACTED))))  they sold us on December 14,2017.     

We recently relocated to the area as a result of a company transfer and worked with The Jessica Hargis Realty company (Shannon Schreyer, was our real estate agent and represented us in purchasing the home).  Shannon showed us a property that her company represented, which backed directly up to a natural wooded area.  A large part of the appeal of this property was the natural reserve area that the home backs up to and the resulting serene and quiet environment that it would provide.   When we asked Shannon about the open tract of land, we were assured that the land could not be developed as it belonged to or was administered by the Engineering Corp/Core and as such no development (commercial or residential) could take place on said land.   This was presented to us as a FACT. 

Based upon this information, we submitted an offer on the home and subsequently closed on the home.  Days after closing and moving in, we were informed by the neighbors that a Commercial Soccer Complex (PIT Soccer Complex) that had been approved earlier in the year for development directly behind our home.  This was a complete shock to us as we had based our purchase on the statements that our real estate agent had made.   Upon calls to Roanoke City and meeting minutes (ROANOKE CITY COUNCIL WORKSHOP MINUTES MARCH 30, 2017 7: 00 P. M) the development was presented to the residents in our neighborhood and questions and/or concerns from upset residents were addressed. This is a commercial enterprise comprised of six indoor and outdoor soccer fields that will be open till 9pm in the evening and will host tournaments, private parties, etc. 

It is abundantly clear to us that this development was well known (or should have been known) long before we purchased the home, but was never disclosed during the sale period leading up to closing.   We acted in reliance on this non-disclosure when assessing the property’s suitability for our needs and submitting and negotiating our offer to the seller to purchase this property.  Had this information been properly disclosed, we would definitely not have moved forward with the purchase of this home.  We believe that the development of Commercial Indoor/Outdoor Soccer fields along with the lighting, parking, and accompanying noise levels that will result, is a substantial omission of a material fact, and adversely affects the value and desirability of the property as well as the livability for us.

We believe the Jessica Hargis Realty has a Fiduciary responsibility to buyers not to make a promise that cannot be kept, (i.e., the verbal commitment where we were assured repeated ably that the land behind our residence could not be developed).  Whether known or (should have been known), The Jessica Hargis Realty company is ultimately responsible in conveying this information to ourselves as it was commonly known to established residences in March of this year (2017).

We have attempted to contact and work with The Jessica Hargis Realty company, but they have ignored our letters and chosen not to communicate with us.  We believe this is a case of misrepresentation and nondisclosure which has resulted in harm to us.
