This letter is to inform The Landings at Buckley that I am disputing the charges of $376.58 for 01-AGL7(property 16908 E Ariatic Dr Apt AGL7 Aurora CO 80013.

The utility billing of 77.17(May) & 87.41(June) I owe you. The $280.00 charge for furniture removal and other misc charges I dispute. Carpet cleaning is regular maintenance and should not be charged extra to tenant. My lease says nothing of this. These are costs-of-doing business for normal wear and tear. I never even wore shoes in the apt so it could not have been very dirty. There was no furniture left in the apt except for a 4 inch memory foam mattress and a blanket (worth $100.00) on the floor. There were 2 trash bags with less that 5 lbs of trash in both. How does this add up to 280.00? I dispute these charges in view of the following:

 When I moved in the apt was not move in ready. It was not cleaned, all the drains were clogged and I had to clean them myself so I could take a bath. The stove didn't work and when the management brought me one that did work it had a short and almost started a fire. I finally got a stove that worked but the drawer was in crooked and when I tried to fix it I cut my hand pretty bad. The pipes in the toilet were duck taped to the wall and remained that why for the entire time I lived there. The porch had no light and it was never fixed though I asked repeatedly. (this is a safety hazard) The heat radiator was in pieces on the floor and didn't work and was never fixed. I had cockroaches and mice that were never addressed though I asked many times. There were live wires hanging from the wall inside the clothes closet in the bedroom. There were no handles on any of the drawers or cupboards in the bathroom and kitchen. The plumbing in the bathtub plunger piece was falling off and I finally calked/glued it together. I noted all these things on my move in form.

In addition, I NEVER HAD ANY HOT WATER. Basically I was told too bad you don't have hot water but the apt complex will not replace the boiler & water heater. It took 10 minutes to get any warm water to come out. I was never told that I had to share my water with the entire building so if there were 10 people taking showers in one apt and I was only taking one shower I had to pay a percentage of everyone's water usage. There must be some law against this and certainly there is a law against not disclosing it to a prospective tenant. There were gangs of teenagers hanging out at my door at all hours. The 1 clothes washer & dryer for our entire building was being lived in a used for a sex closet by teenage gangs.

In view of the aforementioned items, please tell me how I owe the Landings $280.00 for a memory foam mattress and a blanket on the floor? I dispute these charges.

In addition, I am entitled to a 30 day period BEFORE you send this to a collection agency. I received this notice (see attached) on July 20th 2013. You sent in to the collection agency on on July 16th 2013. I vacated my apt on June 30th 2013. This does not give me 30 days notice?

I have filed a complaint with the BBB Case #75201215. It is attached.

I propose to pay you the following:$116.58

77.17 May Utilities

87.4 June Utilities

31.00 one day late with 60 day notice

20.00 (drip pans)

 

215.58-99.00(deposit)=116.58 this is the correct amount that I owe not $376.58.

 

Please recalculate what I owe. 376.58 is unwarranted and unreasonable amount..

 this is part 2 my 2nd issue with The Landings at Buckley:

 I am disputing my rent payment of 670.00 per month from 01/01/12 – 06/30/13. I signed a lease that stated my rent was 630.00 per month. I was told that I had to pay 670.00 per month because you made a mistake. This is not legal and I am requesting a refund.

 Attached is a copy of the first page of my lease. I request a refund of 480.00 for the entire year of overpayment. ($40.00 per month x 12)

 

I have filed a complaint with the BBB regarding this issue. Attached is a copy of the BBB complaintse case # 75201207.

  Please issue me a refund for the amount of $480.00.
