Attended The Learning Annex in November 2005 in New York City. The course was Colossal cash in Commercial Property Over 500 people were told That anyone having Scott Scheel's initial's on the receipt would have the 3 day cooling period extended to 60 day's. His initials were obtained. Upon initial inspection within the 3 daysI discovered it was rather basic and decided to return it right away. They encouraged me to keep reviewing the materials. Every time I wanted to return the books and tapes The phone calls would not be returned and the person handling the return problem could never be located. Their tactic is to delay and stall you until your time is up. Furthermore, I never received the bonus materials because I was trying to cancel the order. When I mention this to them their answer is you are not entitled to the bonus materials since they were on a bonus. Lets get several people together and go to the DA.

The Learning Annex did make the refund and they received their materials back. They have a new customer service director. The one problem I had with the return was I was required to use their Fed Express shipping label. I wanted to purchase insurance on the product. Federal Express said It was not possible to purchase insurance with the type ground shipping label I was required to use.

Their is no question that many speakers get carried away in their refunds policy, during the heat of the presentation. However, I would have never purchased the materials had I not been given at least a 30 day review. And of course, they know that and they sell a lot more product for the small amount of refunds they make; I'm sure they are way ahead. To prevent any future misunderstanding you should record all the promises with your cell phone or a recording devise. And read all the small print before they run your credit card.

The speaker has stated unequivocally there is no such 60 day guarantee, which The Learning Annex confirms. The initials mentioned indicate the student is eligible for a one-day bonus seminar and can receive additional bonus material with their attendance, including a "Market Analysis DVD Set and Research tool, plus a 90 day action plan," as described by the speaker.

Despite this fact, The Learning Annex has made an exception and accepted the customer's request. A refund for the purchasing was issued 5/10/06, in advance of receiving the returned materials, also a severe exception in policy. Initial contact with the customer has not yielded a response, we will continue our attempts to receive compliance on the part of the customer.

Editor: I would like to update story:

I went to the New York Wealth Expo 10/23/2005 at the Learning Annex in New York City. The Learning Annex is a for profit organization. I purchased the Scott Scheel books and tapes unseen for Colo$$al Cash in Commercial Real Estate. Price $1622.37. Upon Examining the the materials I found them rather basic and called Elizabeth Murphy (The Learning Annex) for a refund in the 3 days. I said I would drop off the material to their Manhattan
Office. I was instructed not to do so because they were supposed to be sent to another location. At the Seminar, several thousand people were told by Scott that any one that has his initials on the receipt would have a 60 day review period. I have such initials.

When I again called the Annex, I was encouraged to take my time reviewing the material and the only thing that would prevent a return was if they were damaged. I got this in writing. When I finally got fed up with their stalling because I had made up my mind and did not want to get finance charges on my Capital One credit card. When I wrote to Capital one about the matter I was initially given a credit. However, their attorney Andrew Hyams ESQ (617 9640651, AH@HyamsLaw.com) wrote them I did not have the post mark within the 3 business as set by the Federal Trade Commission regulation, Title 16
Chapture 1, Subchapture D. Part 429. The Learning Annex out right lies on the phone and at the seminar about their refund policy. I appealed this decision with Capital One and was eventually send a letter that there was nothing they could do but I was encouraged by
Capital One to seek alternative means and they would reverse the charge.

I have found another complaint against the Learning Annex in Santa Monica, Ca , with the same speaker and dollar amount as mine. I have found numerous complaints about them for not makings promised refunds. I have also noticed that if you attend their seminar, lets say in CA they want you to return the stuff to NY. In NY they want you to send the stuff to Ca. I think we should get a list purchases of the materials and find out if anyone else is having trouble making a return. I would estimate they sold hundreds of sets at my seminar alone. As a additional complaint against them and it's shows their complete dishonesty, I was only given ? of the materials I paid for. The rest was supposed to be picked up at a free workshop. Since I did not attend the workshop because I was trying to make a return they will not give them to me because they were a ?bonus?. Although, I have paid for this they have told me that since this was a bonus I'm not entitled to it. I think this shows a pattern of dishonestly, lack of integrity and total lack of common sense. I would like nothing less than a full refund and if not given one I will seeking damages: (1) the interest, (2) lost of the use of the money, (3) time lost from work (4) filing fees.
