The Mallard Group Complaint 9/15/2013

When I first had a phone interview with Ryan Faulkner the position we discussed was for a Site Manager and my wife would be an Assistant Manager, if we worked these positions to their satisfaction we would be promoted to Territory Manager and Assistant.

We were to work a store remodel project with one of their Site Managers and would be assessed for the Site Manager positions, after we had completed 4 of these projects Ryan Faulkner told me he would contact the Site Manager for a review, I do not know what was contained in this report but we were put in charge of a crew of 4 employees for a store remodel project at SAKS off 5th Ave. in Cabazon, CA

8-14-2013: First contacted by Ryan Faulkner (Project Manager for The Mallard Group) to see if we (my wife and I) could work a SAKS Off 5th Ave. store remodel in Cabazon, CA. that would run from Sat. 9-17-2013 to Wed. 9-21-2013. He told me that being the store was over 60 miles from my home that we would qualify for per diem pay. ($400.00 a week each, total of $800.00 per week) (verbal)

I explained to him that I did not have the money to rent a hotel room or make the daily commute to Cabazon, CA, he told me “not to worry about it that he would “grab” the hotel room” (Email) and that we would still get our full per diem pay.

He sent me that store address and hotel confirmation under his name (email). I asked Mr. Faulkner who would be Team Lead on this crew during the remodel and he told me that I would be managing the remodel crew, I asked him if we would be getting Team Lead pay and he replied “he was working on it”

We drove to Banning, CA and registered at the hotel, we did make a trip to the SAKS Off 5th Ave. store to make contact with the project manager, and we then went back to the hotel.

During the course of the reset we had many conversations due to required phone and E-mail situation reports, during at least three of these phone conversations I asked Mr. Faulkner about our “team lead” pay per hour and per diem pay and he assured me that we would be getting “Team Lead per diem ($500.00 for me and & $400.00 for Melinda as Assistant) and that he was still working on Team Lead pay”.

During the course of the first few days of the project I was introduced to John Habeck the main contact between SAKs corporate and I during the course of the remodel.

On Wed 9-25 Mr. Habeck contacted me and asked if there were two of my team members who would be willing to wait for truck deliveries as not all parts and displays had been delivered by then, I asked him about hotel room and he said “they would just have to hang around till the trucks came in and then set up the furniture and props and that the room would be paid for.

I told Mr. Habeck that we would remain as we are the Team Leads and knew more about the project, Mr. Faulkner reserved the room in his name.

 We stayed till all deliveries were complete and set all parts/props had been delivered and all assigned work had been completed to store managers satisfaction.

All other legal issues were outlined in our letter of resignation and will be addressed in front of the California Fair Labor Relations Board.
