Thank you Ripoff Report.com again for helping us to not be taken by this "GIFTING" Rip off.

After doing some internet research into starting a homebased business, we were contacted by a person who claimed she was from California. Her name was Julianna and she told us this hearwreching story about how 20 months ago she was a single mother of two on the brink of bankruptcy and now she was making $28,000 a month and putting her kids in private school and building a new home.

She explained to us this new concept of "Gifting" and that was how she generates this impressive income. She then asked us to listen to this conference call that explained it all. She gave us a number and a passcode and my wife listened to the call one day and I the next. You do hear what I believe to be other real people calling in and there is a host who is smooth as silk verbally who then instructs you to press *6 and your call is muted. At this point you cannot talk anymore and for the next 30 minutes several people get on and give you glowing testimonials on how much money they are making. I think all of these participants are canned, as they do not make even a slight bobble in their talk.

Another gentelmen who I call "Smooth Sam," then comes on and explains how it works. So, Sam Smooth lays out this concept of "gifting" where you send your money to Joe and then the next person who you get to sign up after you are in (send in your money, an amount from $500 - $3500) then you will start making all this money. No products of services are changing hands just this magnificent concept of people giving each other money gifts or GIFTING. It is a bit more involved than this but you get the idea. Smooth Sam then tells you to get back to your inviter person and they will tell you where to send the money to and then you can be off on this amazing quest for cash.

There is a slick looking website found at www.noss123.com entitled "The Number One Success System" ya right, talk other people out of their hard earned money and keep it. I think that is called stealing and that is what makes this scam totally illegal.

Thanks to the Ripoffreport.com for having information on this gifting scam. The name "The Number One Success System" and the website www.noss123.com have probably only been around for a short while but this scam has been going on since 2000.

Don't be taken in by these scammers what they do is totally illegal

Looking Into Gifting Programs and Finding Threats, not good

Well, Im on Rip off Report researching gifting programs because Im possibly interested in joining one and I find people from NOSS threatening a person who had something bad to say about the company? Not good business. The first two ladies responses in favor of NOSS were well written and almost convinced me to rethink possibly joining but then there was the reply that was nothing but threats towards the writer of this bad review which made me rethink my rethinking of joining. Threatening people who had a bad experience with your company, and in a public forum no less, is just plain stupid and bad business, And this is coming from someone who is neither in favor nor against gifting programs at this time. Real intelligent folks! I think youve helped me make my decision

I would like to begin by stating that I have never heard of NOSS before this evening. I am a victim of an unscrupulous member of the gifting community. That is not to say that I consider all gifters or gifting programs unscrupulous. I was promiseda "simple proven system" that would have the "cash register ringing".

I sent in my gift and got a website (19.95/month) and one small solo ad along with the promise of being mentored by the number one earner in the program. That was the end of that. I have lost all contact with this person. His site is still up but I have not been able to contact him. He does not return my calls or emails.

I stumbled on to the NOSS site quite by accident. Most of what I see there was also on the scam artists site. I realize that doesn't mean he is a mamber of this program. I was issued a member ID so I entered it into the lost password area. Apparently my ID was recognized and password was emailed somewhere. I assume it went to the scammer.

Can anyone offer some assistance as to how I can contact the administrator of NOSS to find out if I am a member through this guy? If you include some basic contact info I will be in touch. If I am, I want to squash this bug also.
Thanks!

The fellow here that claims its a scam is a liar first of all read his post he never joined the program nor did he spend any money on the program hes simply a little man with nothing but time that he spends bashing others and others programs when he belongs to the program then he may be qualified to give his advice but the fact remains hes a nobody and he couldnt create wealth if it was handed to him.

Noss123 has and is a great program and theres lots of people making money with it it isnt a program where just the top dogs make money everyone makes money period.its a complete level playing field.

So for the last time the clown here from mn is just a troubled child who should grow up and quit talking crap about people he dont know as he points out a single lady who did just what your supposed to do gave him the information let him go to the call then just let him decide for himself.Instead he wants to tell you its a scam yet hes done nothing in the program or anything else whys there so many positive things out there on the program Ill tell you why because it works and folks are making cash with it.

Along with all the other comments, i just had to say my bit too, and no i am not from america but a little island called New Zealand (the one behind Australia).

No-one is pressured into joining this activity, if anything i am proud to be part of this. I have no regrets what so ever, and i have no intentions of going back to financial difficulty. It has become part of my life, its all about struggling together and working as a team to achieve together.

Davin for you to judge the way how other people choose to make a living is absolutely out of the question. The paths we take in life whether they are right or wrong are what makes us who we are. People have beened scammed from so many other programmes along with myself but who's fault is that, we can only blame ourselves.

Now maybe if you would of actually given it a go, rather than making a mockery of it, just maybe you would of seen the results for yourself. But unfortunately, i dont think i would consider inviting you to be blessed with this as you dont deserve it.

My advice to you....Get it right the first time, rather than making a fool of yourself.
NOSS is not a scam and never will be, we are just ordinary people helping each other.

I too would like to say that this davin fellow is simply bashing to bash as ive known the lady julianna for many years and she is truly an amazing lady who has helped countless others to make money just like her she is a single mother who was in bankruptcy and who managed with the noss123 program to scrape together the money to start and then the rest is history as for someone like this davin bashing her grow up you dont know this lady and if you did you would have nothing but good to say about her.

And if I had the time in my life to do this program I would start in a heart beat but im in a business that does vry well thats been in business for many years and im comfortable where Im at in my life.

And the problem with any program or home based business you will always have the davins of the world they never believe therefore they will never succeed at anything it requires a little faith in yourself to succeed and when you dont even belong to a program and you bash it one has to assume either davin has a hidden agenda or hes ignorant and its probably both

This guy wants to have you believe that this little lady who he didnt buy a thing or join the program is just a big scam well we have your info now daven and let me tell you as a friend of julianna that you think you can say these things about this lady makes you a coward and a scumbag as you cant show one bit of proof that she has ever scammed anyone shes an associate of a program you wish to attack someone go after the folks who do scam folks and there in every program on the internet.

The real interesting part of your bs story was she gave you a number to call a conference call and that you thought all the folks on the call are cons of some sort thats the reason your doing nothing but being an a*****e while the rest spend there energy making money and showing countless others to do the same.

You cant just call folks things that are untrue to hurt them and yes this forum is protected but you arent in minnesota folks are looking for you and you will be made to answer to your bullshit once and for all and if this report forum wants to be honest with the folks who come here to look not one of these programs are investigated by you or your forum and you allow any and all to post whatever they want so at the very buttom of this forums page you put the we arent responsible nor de we confirm or deny anything thats printed why dont you post that at the top of your forum as your a scammer looking for donations simply to harm others way to go.

So then theres the advertisements at the bottom of this forum with a program that looks like a similar program to the one your letting folks bash like this loser that didnt join or lose any money at all what a joke.

Maybe its time some of this folks get a life or get made to pay for the harm they try to cause to programs on the internet.

NOSS is NOT a SCAM... It works and will work for ANYONE

After reading Davin's report about Number One Success System, I felt compelled to respond. Too many times, people feel like they need to submit a Ripoff Report because they need to save the world from being scammed. Davin, must feel like he is saving everyone from NOSS. Truth be told, if anyone believes his report, they will be missing out on the best thing that could ever happen to them.

I have only been a member of NOSS for a couple of months and have already received more cash than I was making on my full time job. I quit my job after the first month and now participate in this activity at my leisure. I have more time freedom, more money, and of course less stress. If you are reading the report submitted by Davin, please do yourself a favor and keep a few things in mind before you say "NO" to this activity.

As Rhiana pointed out in her breakdown of Davin's report, that he was called because he "asked" to be called and given information on a way to make money from home. He was invited to the call to get the information that HE asked for. If he and his wife truly understood what they heard on that call, they would realize that this system just makes sense.

Gifting is not a NEW concept. Organized gifting has been around for more than 300 years. It is and always will be legal for people to exchange gifts If gifting were illegal, then the IRS would not have created a tax code for it allowing a one time gift of $11,000 per person per year. It's as legal as you getting a gift on your birthday! Are you scared you are going to be arrested this Holiday Season for all the gifts you will be receiving from and giving to family & friends. Probably not!!

Let me address the comments about the actual call that Davin and his wife were invited to: There are 15 calls per week and they are all LIVE. As you mentioned, you heard several other "real people" calling in and there was a host who was "smooth as silk" verbally instructing you to press *6 and mute your line. Well of course, the host is "smooth as silk"... these calls have been taking place for 6 years .. wouldn't you expect the host to know what he or she is doing?

And as for being instructed to press *6 to mute your line; why is this is a problem for you? Hundreds of people have called in to listen to a conference call. No one wants to be distracted by other people's screaming kids and televisions in the background! Every conference call that I have been a part of regardless of the nature of the call, the host will always ask you to mute your line. This is out of respect for everyone else on the call and to eliminate any distractions. Davin indicated that once he is muted, he is not able to talk for the next 30 minutes while several people get on and give their testimonials....Duh, that's the point. You are supposed to be listening to the call not talking and multi-tasking.

Let's now talk about "Smooth Sam" --- (which of course is not his REAL name, but remember Davin wasn't really listening.. he was too worried about why he couldn't talk anymore). The presentor explains how the system works -- he does all of the explaining for us so that we don't have to. That's what makes NOSS so simple for everyone. He explains everything and then it is up to the guest to get back to their inviter. We don't chase people (which is why Davin never heard from Juliana again). Smart people get it and they call their inviter back to get started.

And yes, we do have a very "slick" looking website. It is very neat and well presented and helps people who have additional questions, to get all of their questions answered so that they can make an intelligent decision on whether or not NOSS is for them.

Davin indicated that we are "talking people out of their hard earned money and keeping it and that's what he calls stealing"... that in itself makes me laugh. This is definately not mine or Webster's definition of stealing. The fact that he has to work hard to earn his money is very unfortunate. If he and his wife had truly taken a genuine look at what Juliana was trying to bless them with, he wouldn't have to keep working so "hard".

You have indicated that NOSS has probably only been around for a short while but this scam has been going on since 2000. You should try to stay away from making assumptions. Let me set the record straight, NOSS has been around for 6 years now and it is not going anywhere. I am pretty sure Juliana gave you her home office number which is still in service. She will continue to generate cash and throw out this financial lifeline to those who see it for what it is. A simple, proven way to generate cash and build wealth -- honestly, ethically, morally and most certainly LEGALLY.

First, I want to say I have no interest in any particular gifting program. That said, I want to make a point about the legality of gifting programs.

From the IRS's standpoint, a cash gift up to $10,000 (perhaps it is more than that now),
may be made to an individual, with no tax consequences. The part that bothers me is the requirement that the person who makes this gift does not have any expectation of receiving anything in return.

In my way of thinking, isn't the individual gifting the cash money expecting to find other people to join in this activity, and asking them to find others to join, and thereby is in fact expecting cash in return?

Just my observation.

That is the IRS link about gifting. I am not an attorney but the IRS law states you can give up to $12,000 away tax free. The is no mention that I found about receiving gifts. How can it be illegal to receive gifts, when it is legal to give gifts?

Number One Success System IS REAL AND IT'S LEGIT

#19UPDATE Employee

Thu, July 19, 2007

I know I will probably be flamed for this, but I wanted to respond to the report filed by Davin in Minnesota concerning Number One Success System and it's legitimacy. I am a member and have worked with them for 4 months as of this writing. I also know a lot of the people working with them, and I am a retired Detective. I have spent a decade researching and trying a LOT of home-based business opportunities, and this gives me a lot of experience in many respects to counter what was posted here by Davin. I speak on my own behalf from my own personal experience, research and investigation.

First of all, every home-based business is not a scam. Yes, there is a 97% or higher failure rate, and not all companies, products or compensation plans are created equally. Most people going into a home business don't have prior business experience, particularly with advertising, and so they flop. Occasionally you do find scam companies that are practicing illegal activities, so it's always good to do thorough research (like with the Better Business Bureau) on the company and owners, and to talk with as many people as you can to get a feel of how successful everyone on average is who is working with them.

That being said, I want to dissect the report Davin wrote concerning Number One Success System. I will put his writing in quotes (including spelling errors and typos) and then respond to each portion of it throughout his report.

"After doing some internet research into starting a homebased business, we were contacted by a person who claimed she was from California."

What this means is Davin was surfing the net for home businesses and found a page with a survey form from a lead-generating company. He filled in the form and the lead was then sold to 2 or more people representing home businesses. It is not mysterious that someone contacted him after he gave out his contact information and gave permission to be contacted. The only way they would have his info is because he gave it.

There's no reason for the person who contacted him to lie about being in California. It's a big state and at this time she would be giving Davin her phone number, which can be reverse traced. Davin's language is already slanting towards bias as if something is already wrong (how did she find me?) and/or devious (she would have given her phone number immediately and later her address if he participated, so it's not like she's not traceable).

"Her name was Julianna and she told us this hearwreching story about how 20 months ago she was a single mother of two on the brink of bankruptcy and now she was making $28,000 a month and putting her kids in private school and building a new home."

There are a number of heart wrenching stories every where you go. Even in a regular sales job with a brick and mortar address, there will be a super star or two with a story like this. In fact, nearly every movie star or famous singer in our culture has a story like this. Why does he automatically assume it's not true for Julianna? If it really is, wouldn't it be worth it to learn what you can from her and duplicate that? I have my own story that's similar, so I can say yes, it really is possible.

How do you know if hers is true? Talk with her. What school are the kids going to? Where is she building her new home? Ask her how many receiving lines she has. Exactly what does she do every single day with her business that generates that kind of cash for her? Break it down. Take notes. Does it add up on paper and make sense?
We can all read people. If she hesitates too much or doesn't seem to know the answers right away, she's probably lying. If she's really doing that well, it'll fly out of her lips easily and with enthusiasm. You can also stay in touch with her for several months and see if she drops out or sticks around. If she's that successful, she'll stick around. However, the way the story is being told, Davin sounds like he's already decided this is a scam and isn't going to bother to look for evidence beyond his assumptions.

"She explained to us this new concept of "Gifting" and that was how she generates this impressive income."

Just because he's never heard of gifting before doesn't mean it's new. People have done this all the way back into ancient times with things such as building homes, community development and helping newlyweds get started. It's still a common practice in many cultures. In our culture it's most common as parents giving money to their children, or donations for various causes.

"She then asked us to listen to this conference call that explained it all. I think all of these participants are canned, as they do not make even a slight bobble in their talk."

Don't be distracted by the non-important pouring of details here--it doesn't replace thorough research nor does it make him an expert in this discussion. Yes, the people calling in are real. There are several hundred if not a thousand people per call. The only way the presenter can be heard is by keeping folks quite through muting. The presenter does this 15 times a week, and yes, he is very good. He's there because he's good and being good doesn't make him a fraud. And yes, the people giving testimonials are real. I speak with them on a daily or weekly basis in our training meetings and they've been around for a long time. In our meetings they are constantly asking all of us to step up and do testimonials for the calls, too. If this wasn't working there would be a high turnover. And because it's not a pyramid structure, all the money is NOT being funneled to the top people, funding and supporting the speakers. It really is a level playing field, so if they stick around, there's a reason.

"Another gentelmen who I call "Smooth Sam," then comes on and explains how it works.
Smooth Sam then tells you to get back to your inviter person and they will tell you where to send the money to and then you can be off on this amazing quest for cash."

Again, by nicknaming the presenter as if he is a snake-oil salesman, there's a bias for no reason that's specified, other than that he's a good speaker/presenter. Davin also shows that he feels uncomfortable with the idea of gifting by referring to it in ALL CAPS and making it sound mystical like a Dungeons and Dragons "quest". It would seem he doesn't understand the concept or that it works. Even if he did, not liking it or agreeing with the program would be an opinion, not fact that it is a scam.

"There is a slick looking website found at www.noss123.com entitled "The Number One Success System" ya right, talk other people out of their hard earned money and keep it. I think that is called stealing and that is what makes this scam totally illegal."

Because the site looks professional does not mean it's a scam. He's speaking in biased terms again by calling it "slick". In fact, usually the websites for scams are chintzy because they are thrown together quickly and brought down quickly. They are even often filled with typos. Do research on the net for scams and you'll see in the tips section that many often look very thrown together.

And as far as talking anyone out of money, Davin never says anywhere in his "report" that he was asked for money. Firstly, he filled out a form on line requesting that someone contact him about a home business opportunity. Then he was presented with information. In fact, speaking as someone participating in this program, I only talk to people who contact me for information. They call me first. We give them the information and then they decide for themselves. We don't chase anyone or talk people into anything. It's completely up to them. Davin mentions no where that Julianna ever called him again. I don't see anywhere in this "report" that Davin was asked for money or hounded in any way. She shared her story and directed him to more information, and then left it up to him. That's not what I would call talking people out of their money.

Stealing? "I think that is called stealing and that is what makes this scam totally illegal." That's his conclusion? The concept of private gifting is based upon the fact that both American and Canadian citizens have the Constitutional right to gift property, cash and other assets, and are subject to the rules and regulations established by the laws. The U.S. gifting rules are found in the IRS Tax Code, Title 26, Sections 2501-2504 and 2511. The law states that one or more individuals can give a gift to another individual of up to $11,000 each per calendar year without any tax liability to either the giver or receiver of the gift, because the tax on the gift has already been paid. These gifts are not included in the gross income of the recipient.

Because Davin doesn't understand the concept of gifting does NOT make it illegal. Because he may not want to participate or doesn't like it doesn't make it a scam.

"Thanks to the Ripoffreport.com for having information on this gifting scam. The name "The Number One Success System" and the website www.noss123.com have probably only been around for a short while but this scam has been going on since 2000.

Again, lack of understanding, thorough research, an open mind or due diligence. He provides no clear evidence of any kind that anything or anyone here did something wrong. That doesn't make it a scam. The program is long-standing and stable. If what Davin claims were true, it would have been shut down a long time ago. It's fine for him to have an opinion, but that's a far reach from enough substantial evidence to slander an organization because it's not the right choice for him. Almost every single person I know involved in this group is generating money and they are happy, as opposed to every mlm I've ever researched or participated in, where it's the opposite--almost everyone is broke and desperately hopeful.

I am not saying that this program is the right one for everyone, and that's ok. I'm personally only interested in working with people who are excited about it. I just ask that folks take Davin's "report" with some salt and really find out what's fact and what's opinion, and let them decide for themselves.

Thank you Ripoff Report.com again for helping us to not be taken by this "GIFTING" Rip off.

After doing some internet research into starting a home based business, we were contacted by a person who claimed she was from California. Her name was Juliana and she told us this heart-wreching story about how 20 months ago she was a single mother of two on the brink of bankruptcy and now she was making $28,000 a month and putting her kids in private school and building a new home.

Another gentleman who I call "Smooth Sam," then comes on and explains how it works.
