Oct 17, 2009 received packet from TOA to prepare our data of our timeshare/ (1) Testimony of misrepresentation from Wyndham by WorldMark (2) Affidavit to revoke automatic withdrawals from WorldMark (3) letter to Wyndham Resort Development Corp. our intend to discontinue further payments (4) letter of legal notice of Fair Debt Act (5) check for $550.00 (6) W-9




Oct 21, 2009, signed contract that was mailed to us.




Oct 21, 2009, registered mailed back along with General Affidavit and Authorization letter (LPOA) with the second payment of $550.00.




Oct 23, 2009, Taylor Monroe (TOA) emailed that we should go to our bank to discontinue draft for Wyndham and WorldMark.  That was done.




Nov 3, 2009, email from Christina Malone (TOA)that our case was sent to Wyndham by WorldMark 10/30/09 and they would have 30 to 45 days to respond to TOA's resolutions department.  Any correspondence we receive from Wyndham we were to forward to TOA.




Nov 4, 2009, we received a voicemail from WorldMark (Amy).  We notified TOA.  Christina Malone said the next time they call to give them TOA's phone.  So I called WorldMark but was only able to leave a message to call TOA.  She also told us to put stop payments with our bank to Wyndham by WorldMark.




Nov 7, 2009, WorldMark (Amy) returned our call.  She said she was just doing a general customer service call to update us on purchase of points.  We told her that we were wanting to sell and she said that was not her end of work.




Nov 7, 2009, emailed Christina and gave her this information.




Nov 17, 2009, We received a call from 512-488-0060 interested in selling our timeshare.  We gave her TOA's number.  We emailed Christina to make her aware of this.




Nov 17, 2009, Response from TOA.  Currently TOA and Wyndham Vaction Ownership are parties to a federal lawsuit in U S Dist Ctt for the Middle Diostrict of TN at Nashville.  Because TOA has entered into a Preliminary Injunction pending the outcome of this case, I am required to inform you that we, TOA's, are temporarily unable to assist you as we continue to battle on your behalf.  You are encouraged to continue to contact Wyndham directly to follow up on your case which has already been submitted.  This is all I am able to tell you at this time regarding this matter.  Thank you for your inquiry...Christina Malone




 




Feb 11, 2010 TOA filed for bankruptcy under Chapter 7, case number 3:10-bk-01391.  In April the case was closed and I could not retrieve the results.
