I have and old Sears credit card that I only bought a coffee maker and grinder with . The credit limit was 250.00. According to the Experian credit report. Sears sold this to a collector, and now a collector name Phoenix Recovery Group, has turned it over to a lawyer here in Georgia.First I was given a summons by the State court for a Complaint on a contract. They are trying to sue me for 560.00 plus attorney's fees for a total of around 1000.00.I answered their complaint with a Motion for a Bill of Complaint. They sent me a letter saying it was for Sears and a copy of a blank contract with no signature on it. I then filed a Motion for a more Definite Statement. I have yet to receive an answer on it. Then they sent me a Motion of Discovery. I then filed a Motion to Strike as unresponsive.


They then responded to my motion to Strike by asking the court ot deny my motion because they said "all arguments raised by defendant are issues of fact for determination by the factfinder at trial." The Judge then granted an order that my Motion to Strike, Motion for a more Definite statement, and Motion for a Bill of Complaint be denied.I answered their motion of Discovery by saying I don't remember or have any documents they are requesting. What should I do now? I really feel these people are trying to take advantage of me because they know hiring a attorney would cost as much they are suing for
