We contracted with The Pool Store to build a pool in a six-week timeframe. The pool was started in July, 2003 and still has not been completed. The entire project was a nightmare from the beginning. In January, 2004 he informed us that he is financially unable to complete the project even though he has been paid in full for the project. Our deck is crumbling and looks terrible, the wall between the spa and pool is too short, the plumbing had to be redone, some of the equipment is missing.

We had to pay another contractor 3000.00 to come in an rework the plumbing and add the missing equipment. We have paid 1335.00 for the electricians to come out. All of this was included in the contract that has not been honored by The Pool Store. We are going to have to pay another 5000.00 to have the work to the deck corrected.

I would advise anyone thinking about using The Pool Store to rethink their decision. This company is the most dishonest company I have ever dealt with personally or professionally. They are the true meaning of rip-off artists.

DARLENE MAXWELL CLAIMS ARE FALSE and SPUN

#2REBUTTAL Owner of company

#1 You claim in the report that you contracted with THE POOL STORE to build the pool, YET, in another you claim the same issues, about same pool, but SAY you contracted with ATLANTIS POOLSCAPES. Which is it? You prove this is simply a vengence weapon, so you can harm and defame, and lie to complete the deed.

#2 You claim we agreed to 6 week completion, that is standard, and its also standard to have 5 makeup days for every rain day. IT RAINED. So your claim is half truth.

#3 The financial problem came from TERRY WILKERSON of MORGAN STANLEY, and his home builder JIM HIGGENBATHAM, a title company and mortgage company who all allowed the house to close without the pool being paid for, the builder denied he knew, the title company denied a pool was in the backyard, though permits and inspections for it were public recordfrom 2003. The Dallas Apprasial Distict did not even have it on the tax roll in 2006, after my irrate call they added it. Fact is you took this misfortune and attempted to leverage me with the plaster check. This non payment, allows me to cease work and relieves me of obligation to warranty it either. Your choice, and by the way we retain title to all equipment until paid in full. AS PER CONTRACT.

#4 Your claim that deck is crumbling, is attached to CONCRETE, with a 1 year warranty. Because your soil in Caddo mills, red sand and clay, moves badly, and must be watered. Did you irrigate during the 2 year drought? We will never know because you never had a third person non biased entity validate your claim. You never brought a lawsuit because you could not prove full payment. Therefore no standing.

#5 Spa wall could have been adjusted by Plaster crew, but we did not do it.

#6 Any work conducted by others was your decision, a violation of the agreement to a) pay us, b) give proper notice of defect or warranty claim, and give us time to remedy it, c) yOU DID NOT HAVE A THIRD PARTY VALIDATE YOUR CLAIM AS PER CONTRACT.

#7 aLL Monies paid to scott hanson were payments due at progression stages of completed work, therefore you were not stolen from, we completed work, like the decking we were at untill 11pm to complete.
