Complaint Review: The Roth Morgan Firm

The Roth Morgan Firm Trying to shake down on a debt discharged by Chapter 7 Orlando Florida

  • Reported By:
    Lea — Rockford Illinois USA

Rec'd a letter from The Roth Morgan Firm dated 3/2/17 on 3/10/17. The letter states I owe $2538.35 on a Fifth Third Bank account that was charged off on 1/11/12 (don't even remember having an account at this bank). Anyway, it says to call a number if I dispute it which I did & left a voicemail on their answering machine. There was no name of a specific person attached to this letter.

I did a Chapter 7 in 2013 in which all my legal debts were discharged. I left the case number on their answering maching along with the Illinois statute that states this is an unsecured debt & can't be collected on after 3 years of discharge.

Although this debt originated from Fifth Third Bank, there is no affiliation between Fifth Third Bank and the Roth Morgan.  Roth Morgan is a third party debt collector.

If there is no debt with 5/3rd than they essentially gave your private info to a scam. They used to be known as roth, morgan and associates before when they sent me pretty much the same letter. I would recommend contacting the FDLE (florida department of law enforcement) or your local sheriffs office. Make sure you still have the letter.

Banruptcy Laws

Since you filed Bankruptcy and the bank wasn't notified your account was submitted by Fifth Third Bank. There is no scam here, a simple phone call to our office and we will add you to our bankruptcy list and your case will be closed. It was your attorney's job to notify your creditors and obviously that didn't happen. Please contact the general manager David Shapiro at 888-600-1698 ext 1011 and your case will be closed immediately. Our portfolio has been validated through Fifth Third Bank and since it was added to your bankruptcy you owed the client these monies at one point in time. If you need any assistance please contact our firm instead of making assumptions that aren't correct.
