I placed an order for concert tickets with this website. The ad read
Seats: Section: 110 Row: 24 Mid Field - Perfect Row - $73 dollars 4 x $73.00, with service and delivery Total: $361.04

I received a confirmation of this order. The next day I received a phone call stating that the tix were no longer available, and offering me $300 tickets or lower quality seats, none of these being comparable choices. The company denied the order confirmation, which I have in writing.

This is a classic bait and switch tactic, and is illegal.

This complaint is not really accurate. Elements of what was stated are true, but other statements are false and/or distorted.

MyCityRocks operates a popular ticket exchange (http://tickets.MyCityRocks.com) that allows people to buy and sell tickets from each other all over the world. MyCityRocks, however, is not a ticket seller... we simply operate a ticket exchange that allows people to buy and sell from one another if they choose to do so. This is clearly stated on each and every page with a ticket listing on our site, as well as in the terms and conditions that customers must agree to when buying tickets from the third-parties selling them on our web site.

This individual did indeed place an order for tickets using the MyCityRocks Ticket Exchange. This order was placed to buy tickets from a company listing those tickets for sale using our web site. Upon submission of their order, the consumer was sent an automatic receipt acknowledging the order that was submitted (but not that the order was accepted) along with the contact information for the ticket seller. This receipt also would have stated the following:

"Occasionally the tickets you requested may no longer be available at the time your order is received. If equivalent or better seats are available for the same price as your initial order, and you have specified you will accept equivalent or better seats, you will receive the alternate tickets. If your order cannot be fulfilled, you should be notified in a timely manner by [The Name of the Ticket Seller]."

Similar language, indicating that a submitted order cannot be guaranteed until it is accepted by the ticket seller was also provided to the consumer in our site policies and in the terms and conditions that the consumer agreed to upon checkout prior to placing their order.

The reason we have this policy is because very often the people who sell tickets on our web site will list them for sale through a variety of different forums and web sites. It does not happen often, but on occasion it so happens that the tickets listed by a seller were in fact already sold through another channel and the ticket seller did not yet have a chance to remove the listing from our site. When that situation occurs, the ticket seller is required to reject the placed order and notify the customer in a timely fashion (usually within 24 hours) so that the ticket buyer can make alternative arrangements to purchase tickets for the event in as timely a manner as possible. That is exactly what happened in this instance. The placed order was rejected in a timely and professional manner and the buyer was notified and they were not charged for the tickets. It should also be noted that at no time did MyCityRocks place any advertisement stating the prices of tickets available through our ticket exchange. The inventory offered by the ticket sellers on our web site is constantly changing, so doing so would not be possible.

When a placed order is rejected because the specific tickets requested are no longer available, then we will sometimes offer a consumer an option to purchase alternate tickets for the event if we have other sellers listing such tickets for sale through our web site (or even with other tickets available from the original seller, if the seller has other tickets). Such tickets may be available for better or worse seating than the originally requested tickets, and at a price that may be more or less than the price of the originally requested tickets. In each case, the consumer is under absolutely no obligation to purchase such alternate tickets. In many cases, we are in fact able to find the consumer better tickets at a lower price, but such is not always the case. We feel that giving the consumer this choice, when it is available, at least gives them the option to see the show that they wanted to see, when the tickets that they originally tried to purchase are no longer available.

MyCityRocks works hard to operate a ticket exchange that allows people to buy and sell tickets in a manner that is fair to both ticket buyers and ticket sellers, and that provides appropriate guarantees to consumers so that they can shop for tickets with confidence that they will not get ripped off. Instances of poor behavior by a ticket seller are extremely rare. We actively investigate complaints against the sellers on our site, and can and do fine or penalize them if we discover that they have not operated professionally, and we will also provide consumers with appropriate make-goods in such instances. While we regret that the tickets that this consumer tried to purchase were no longer available from the seller at the time at which their ticket request was processed, it does appear that the consumer was notified that such was the case in a timely and professional manner, and that the ticket seller has not acted in violation of our policies.
