Timber Lodge RV Resort, Inc. - Jim Jerde, We contated Jim Jerde by phone and discussed the membership--we were told by Jim that we could cancel at anytime the life time membership without penatly -by putting the cancelation in writing after 4 years at whcih time we did so, now we are being milked for $399.00 for them to sell the membership and our bound by life and the fourth dealth of someone-- we are now being threaten with collection a New Waverly, Texas

On April 22, 2004, we signed a contract with Timber Lodge RV Resort, we were informed via Jim Jerde, "that at any time in writing" we could cancel this contract, and/or after 4 years we could have Timber Lodge sell the contract for us. We submitted our cancellation to Timber Lodge and requested cancellation immediately, we received a letter June 30, 2008 informing us that we must continue for life to pay the dues and that if we want Timber Lodge to sell the contract for us we must pay them $399.00 for services.

We have currently invested over a thousand dollars without ever stepping foot on the property and want to cancel this contract, We are being threatened by them if we don't pay our dues we will be turned over to Monterey Financial Nationwide collection Agency for full remedy and being reported to the national credit agency which will reflect on our credit standing, plus additional fees will be charged to us for these services.

We have called many times with no results and apparently our cancellation letter didn't do any good.

They are milking us for a lifetime contract of which we were told was easily cancelled in writing at anytime. , From reading the other Timber Lodge complaints we are all in the same boat.

How can we get out of this contract?

Our records indicate Donald and Nancy Disonell purchased a membership to Timber Lodge RV Resort through our brokerage firm in April 2004. That the membership agreement is an industry standard agreement.

That our company acted as a broker in the transaction. That the membership agreement is not with our company, but with Timber Lodge RV Resort, Inc. Cancellation of the agreement is between Mr. and Mrs. Disonell and Timber Lodge RV Resort, Inc. That we have no authority to cancel or otherwise negotiate any provision of the membership agreement.

That no representation including, but not limited to, cancelation policies outside of the membership agreement itself was ever made.

Campground memberships generally are not something you purchase to go on one trip or for a year or so. Other outdoor options exist such as government and public parks, seasonal lot rentals and others.

As a matter of membership comparison lets look at Thousand Trails "(TT)". TT charges annual dues around $500.00. TT does define a term in their most recent agreement, ten (10) years. If a TT member requests early termination after, lets say, three years they have the choice of a) locating a qualified buyer ( which is also an option previously provided Mr. and Mrs. Disonell) or b) pay the remaining years off (seven (7) years times $500.00 some $3500.00).

We have contacted Timber Lodge RV Resort regarding this matter and they have provided the following information.

That in June 2008 Mr. and Mrs. Disonell sent notice they would like to terminate the agreement. That on June 30,2008 they were provided with several options in which to terminate the agreement. That several options including the resale and prepayment options are not provisions of the agreement but were made available in good faith in order to accommodate their request to cancel.

That in December 2008 they paid a $399 resale fee which incuded taking over the membership, releasing them from any further obligations, advertising and commission costs and fees.

That from their joining (2004) up to cancelation of the membership the total they received from Mr. and Mrs. Disonell was $495.
