About 4 years ago..I may not be correct in the time line, it has been a long time, I was stupid enough to get a small loan from TitleMax. I was a single mom working 2 jobs trying to go to school, not getting any child support. My hours were cut at my 2nd job and money was very tight. As a result my electricity was shut off and I was going to be late on my rent. I had driven by TitleMax on my way back and forth to work and desperate went in to see what it was all about.

The rep was very kind, seemed very sympathetic to my plight and made it sound like they were the answer to my prayers, actually made it sound like they were the only answer. They gave me $800, which I didn't think was very much but given the situation, I didn't have much choice. I got my electricty turned back on and paid my rent. What wasn't explained to me was the outrageous interest rate or that I would have to sign a new contract every 30 days. I could barely pay over the interest rate every month.

I ended up moving out of state to NC. I have lived here now for over 2 years..and guess what? I am STILL paying on this thing. I always pay at the same time every month but the phone calls start earlier and earlier.

At first when I moved, they said because I was out of state I could not renew my contract, so I have not signed a contract with them for over 2 years. They tried charging me late fees, equaling an absurd amount of money. Then they said they couldn't charge me late fees anymore either. I was like Thank God. Because the interest is so high I am still barely able to pay over the interest every month. And the phone calls never stop. Recently they have started calling my mother.

Well, now I am engaged trying to build a life with my fiance..the car that I have the loan through TitleMax is falling apart and now needs it's second new transmission. We decided to get a new vehicle and use that one as a trade in. I told the dealership that TitleMax holds the title on it and they are willing to pay off the remaining balance.

TitleMax calls again and I explain to them that I am trading in the vehicle and that the dealership will be in contact with them about a pay off. The rep actually got irate. She demanded a payment that day. I said that wouldn't make any sense because the dealership is paying them off. That we were just waiting on them to locate a vehicle within the limits of our loan qualifications.

She then made threats to destroy my ( and my fiance's, it is going by his employment) loan. She said that would she would tell them horrible things about me to make them cancel our approval. Now I have never missed a payment with these people, have always paid the 26th of every month, but without a contract they call whenever they please to demand payment. She said either I make a payment or else.

I have never been so confused in my life..why would a lender get pi**ed off that they were getting paid off???

I have since found out that places like TitleMax are illegal in NC and that kind of business practice is exactly why. Now I am scared they will try to come in the middle of the night to get my car to mess up our loan for the new car.

I have contacted the Attorner General's Office of NC and he strongly suggested I contact the Attorney General of GA, which I have. I am now just waiting to hear back from them. Anybody have any ideas?

Read your contract, this is a 30 DAY pawn not one month. If there is 31 days in a month the date would go back one day. (Not a titelmax rule, state law that they are 30 days). If you are late they will call you, if they cannot get ahold of you they will contact your references. But, if you want to complain about your rates you should check other title pawns first. While the others charge 22% or more you are probaly paying 15 or less. They have the lowest rates, and is not there fault you did not pay on time.
They are right if you do not pay they can come get the vehicle, if you are trading your vehicle it DOES NOT cancel your contract and obligation to pay them and keep current.

Well they have been calling and harrassing my mother who up till now had no idea I even had a loan with titlemax, now because of them she knows everything about it. They told her everything..which isn't loan info supposed to stay confidential? They have continued to call and won't stop..so I finally agreed to just pay the whole thing off..I still have not heard back from the Attorney General's office. SO after I sent out the money order I find out that they had still been charging me late fees that I wasn't supposed to be charged. I am still waiting for my title from them.

This is typical Titlemax collection tactics. As you can read in reports I have posted here on this company and the actions I am taking against them about this kind of collection activity that is apparent the are trained to practice or just have total disregard for collection laws. May I suggest that first of all that you file a complaint with the Federal Trade Commission. The more they are reported to them will continue to raise a red flag with the commission and soon will prompt them to investigate and hopefully get the United States Attorney General to file on them in federal court and fine them heavily and put them on for lack of better words like probation.


Also I recommend you call them out and tell them to call your future husbands place of employment along with the dealership and you are trading your car with. Tell them to make sure that they disclose all your personal information about your loan with both of these places. Trust me it will not surprise me if they do it. They don't seem to be very well trained in areas of breaking collection laws. If they do this contact a attorney in the state of North Carolina and file civil litigation on them. Titlemax appears to me to think they are invincible when it comes to laws they have to abide by and from there on actions think they are above the LAW.


I know in the lawsuit I have filed against them they have hired a law firm in Columbia , SC to represent them in the matter. This law firm apparently is the largest law firm in the state of South Carolina and apparently one of its specialty's of there practice is torts defense. I am sure the rates they charge do not come cheap and according to there web site they have like 454 lawyers all together and like 54 of the top 100 lawyers in America. As you can tell this really impresses me. I personally hope that when my case with them comes to trial that they bring all 54 of the best with them.
I am 100 percent convinced that there actions have ZERO chance of any defense.

And when they really figure this out I personally can't wait to prove to them that I gave them fair warning of my intentions if they didn't halt there collection tactics. But it did no good until my attorney filed suit against them on my behalf. I think we may now have there attention to some degree. But to tell you the truth it wouldn't surprise me if they didn't call my house again tomorrow because as I stated before I honestly think that they think there above the law.
