TMobile charged me $150.00 for a Samsung R225 which costs $99.00. My original phone was stolen.

Before six months usage it needed to be replaced.
They sent me a refurbished phone, no battery, and no sim card. This is all we could do for you.

I was overcharged for the phone; when I could retrieve no proper usage they sent me a second hand phone.

It does not say in the contract that you would not receive a new phone.
I asked for someone with power in the company to help solve the situation and was told that there is no one.

Yes, the cost of a mobile phone to replace a lost/stolen handset may be more than the "New Activation" cost. We do not profit from the discounted handsets offered upon activation. Especially the free handsets. In fact we lose money from the new activation handsets. This is reason for contract, to ensure recovery of the losses from the equipment of the year(contracts are no more than 12 months).
You stated that we sent you a refurbished handset w/o battery or sim w/ a $150 charge... that brings me to the conclusion that you did not request a replacement for a "lost/stolen" unit.

This can only happen when the user fraudulently claims that their handset is defective and TMobile in "goodwill" issues a replacement handset along w/ warranty for the defective device only, with expectations that the user will ship the defective back(shipping is all covered at our cost). Upon sending that replacement we advise the user of returning the defective handset or they will be charged the "cost TMobile pays to cover equip costs" with the manufacturer. We warranty the handset at your convenience.

Otherwise, the user would have to go through the headaches of dealing w/ the mfgr. We stated exactly what you received prior to shipping that handset. We even advised that the charges applied for nonreturned handset may not be price initially paid for by the consumer. This tells you that we lost $50 on the handset issued to you initially by discounting at $99. TMobile is more than fair and gives a lot of leiniency. TMobile, however, will not be responsible for anymore equipment cost losses due to incident at no fault of our own.

You sir tried to get over on TMobile and you thought you got away w/ it. No, you will pay for cost of your handset that YOU are responsible for when we catch it and is charged on your bill a couple months later. If this was a legitimate "rip-off" statement, then you should have called cust care and we would have offered options of costs for New Handset, which due to our order mistake would have expressed shipped the handset at our expense. But...you didn't call w/ the problem until you saw your bill a couple months later.

The costs of the new handset would have been more than the $150 restocking fee, unless you have exceeded your contract period on a qualified rate plan to get the "New Activation" discounts and rebates. Now, I believe those that read my rebuttal understand that your have given yourself the image of a "fool".

I have a T- mobile account for my daughter. After 6 months the display on the phone no longer worked. I called T mobile and the gal told me they would send me another phone, just the phone, not a battery or a sim card. The battery and sim card from the old phone was to be put into the new phone. Then the old phone only was mailed back in the same box. There was even a label to charge the shipping to T-Mobile.
Easy as pie, and no cost at all.

Then we found our replacement phone had no ringer at all. So I called T Mobile again. The gal told me they would send me yet another phone, same deal, move the battery and sim card into this new replacement phone. She also said Tmobile would credit my account $15 for my trouble, and they did immediately.
