Toftum Homes for Living John & Jean Toftum Forced me into signing an illegal duplex rental contract in September 2004 New London Wisconsin
I rented a 2 br apartment from Mr Toftum in Amherst, WI from 8/2003 to 11/2004. Mr Toftum came over in Septmber 2004 & pressured me into signing a contract for a 2 br duplex down the street that wasn't even built. I bought a house in November 2004 & moved out.
The contract stated "Move in date- February 1st, 2005 or whenever finished". Mr Toftum sued me in Portage County, WI small claims court in August 2005. I hired Robert G. Hill,Attorney at Law, in Plover, WI. I paid him $500 by check. He said the contract wasn't legal, but didn't do anything in court. Judge John Finn awarded Mr Toftum $3199.99 for default. I filed an Appeal, paid Waupaca County Sheriffs Department fees, too.
Mr Toftum showed up in court. I showed up by myself. Judge John Finn dismissed the case saying "You don't have a claim".
It was clearly an illegal cntract. I was screwed out of about $3,900 in total.
