To set the record clear and straight with the Public, I was made aware by a third party that Tom Boone aka Thomas K. Boone, attorney at Law in Dallas, Texas has been misrepresenting the facts regarding a boundary line disagreement and lawsuit that was filed by his mother, Dorothy Boone aka Dot Boone.

To begin with, the house that my wife and I purchased was stated to have a 50 foot width from the SE corner of our alley to the SW corner. These measurements were stated and flagged by a previous surveyor for several years prior without questioning by Dot Boone, our neighbor, or her son Tom Boone.

When we purchased the house next to her in 2002, I built a fence from the Southwest corner of my guesthouse to about 20 feet running North to the end of my guest house. This was done on the 50 feet width according to my survey.

After building the fence in November, 2002, Dorothy Boone and her son, Tom Boone aka Thomas K. Boone, knocked on my door in which Dorothy Boone came in with her son, Tom, and inroduced him. She said that she wanted to introduce her son, and to tell my wife and I how nice the fence was. Tom Boone pulled out his business card and told me that if I ever needed his legal services to give him a call. Nothing was ever disputed then or prioe when I even gave Dorothy Boone a copy of our survey prior to building this fence in 2002.

As time passed, April, 2004, was when Dorothy Boone sprayed a chemical all over my brand new Lexus and left it to soak on the paint. It was a hot and sunny day and Dorothy Boone did not bother to tell me what she had done. I was surprised with her actions because prior to this misbehavior by her, Dorothy Boone did nothing but tell her son Tom Boone and other third parties what a "great neighbor" I was to her.

Well, I went out to investigate and then noticed the smell of Diazinon, a pesticide used to kill bugs. I inspected this sprayed on my car and went around to speak to Dorothy Boone and caught her with the bottle of pesticide in her hand. I asked her why she didn't bother to let me know and her reply was that she could have taken the time to, but didn't.

Well, I kindly contacted her son, Tom, the lawyer, and left him a message. My telephone call was not returned for over a week. I wonder why? My wife and I were pretty frustrated, so we decided to build a fence that ran from a 7 foot brick wall built by Dorothy boone and her late husband, Thomas Boone, Sr. and ran about 20 feet North to the end of our house.

Before I did ths, I properly filed a permit with the Town of Highland Park (located within Dallas, Texas) and was instructed by Kirk Smith, Town inspector, exactly where to dig. I began that same afternoon to dig my holes and was approached by Tom Boone that afternoon in which he aggressively began taking picture and chanting "you better have a permit buddy." I took this as a threat and file a complaint with the Highland Park Police Department, tele. 214-521-5000.

I then had to file several tresspasing complaints against Dorothy Boone and her attorney son, Tom Boone. Tom Boone then began writing Cease and Desist threats to the Town of Highland Park to get the Town to stop me from building my fence. His request were rejected several times in which he was told I had every legal right to build a fence on my property. I then had to file a complaint with the Texas State Bar to complain that I felt Tom Boone broke his cliet-attorney privelege with me for filing Cease and Desist requests with the Town of Highland Park.

For everyone's information, I trusted Tom Boone regarding his legal services and advice on two (2) differnet occassions after him soliciting me for work, and that was a BIGGGG Huge Mistake!!

In the meantime, I had voluntarily stopped my fence building to bring peace, but this did not help because Tom Boone was set to get revenge, and my wife and I were soon to be sued by Dorothy Boone on the advice of her son, Tom Boone.

We were pretty amazed of the outright lies that were filed in Dororthy Boone's Plaintiff's Original Petition Case # D0060526944-H, Dallas, Tx. I believe just about every claim that Dorothy Boone made in this lawsuit was outright false and misrepresentated facts to the Honorable Judge Cox's court. Borderline perjury! We could not believe that an 80 something year old woman would even file such ridiculous allegations in order to gain a few inches of property.

But as I believe, her son Tom Boone was advising her and stuffing my mailbox himself personally with intimidation letters with his law firms letterhead on them. Tom Boone even involved his wife and children by casing my house and waiting for me to leave in order to stop in front of my house, jumping out of their car, running into my driveway, and taking pictures of an iron pipe that I uncovered for my surveyors.

Tom Boone really knows how to get the entire family involved, in which I can't believe that he would send his child into my driveway to take pictures, muchless get his mother involved in a lawsuit at her age??? My wife and I would have settled this without such suit.

Well, as time passed with this lawsuit, their attorney who they originally filed the lawsuit through, Paul Talmage Boston, apologized to me via e-mail after I began threatening countersuits for slander and libel for false court filings. I believe his apology went something like "I'm sorry for any statements that were made that were inaccurate and/or without intention...." (I can dig out the exact words if necessary). Morover, Dorothy Boone began soliciting neighbors in which I understood that I was becoming the victim of "badmouthing".

This was unbelievable that our neighbor, Dorothy Boone, would do this. This is an individual that stood with my wife and I in front of Highland Park United Methodist Church after our babtism to the church. Moreover, her son Tom Boone sings in the Highland Park Methodist Church choir. My Christian understanding was to try to resolve conflict with the help of the Church so I talked to Rev. Linda Robbi several times on my own effort, and, was referred by her to Rev. Steve Mathews, second in command under Rev. Mark Craig.

After taking my time to explain to Rev. Mathews my concerns and troubles with these "untruthful claims" in this lawsuit, I was told by Rev. Mathews that "s**t Happens" and that "he and his wife also "tweaked" a legal court filing in order to work the legal system to their family's advantage". How sad it is that not only do members of the church misrepresent legal facts, but senior Reverends do the same thing. Nothing but lies, lies, and more lies. I guess not many people learn from the teachings of Jesus Christ. So as time moves on, my wife and I were still mending from the loss of my mother from a terrible car accident (in which the Boone's knew about) and at the time my mother-in-law was ill with walking pnemonia, and other issues due to Tom Boones bad past legal advice.

So I tried to resolve this lawsuit by agreeing to sign this "boundary line agreement" without further court proceedings and without adding any more stress to the life of myself and my wife. Well, apparently, trying to do a good thing to a resolve this issue was just "used" by Tome Boone to take further advantage of us. I received calls from Tom Boone claiming to want to help me move a fence post in the SW corner of my property, so I agreed.

Mr. Boone went back in the alley and began digging. He apparently from what I saw dug past property "iron rod(s)" out, and when I questioned him about doing this he said "it was just laying there".. Sounds kinda illegal to me. Tom Boone had his survey company come out for his mother, Analytical Surveys, 972-272-6287 and set an iron rod(s) at the SW corner of my property. Tom Boone also solicited Quality Fence Co. in Dallas to begin constructing a fence without my permission and WITHOUT A PERMIT from the Town of Highland Park.

Soon after work began, the property inspector of Highland Park ran them off and reprimanded Tom Boone. I had to file a Motion for Injunctive Relief in Judge Cox's court to enjoin all of them (Boone's) from attempting to ilegally to build a fence. Unfortunately, due to my mistake, I did'nt "Verify" my motion, so the judge was very nice about it a denied it due to a "technicality". I refiled the Motion, and did not persue it because my wife and I decided to sign the "Agreement" and to move on.

My wife and I graciously volunteered and agreed to sign a boundary line agreement out of kindness and to stop the harassment, intimidation and lies. We also agreed to void a prior agreement "Vance-Chandler" that governed the issue of our driveway and it's placement. We allowed Dorothy Boone to cut it approximately 5 inches to the East.

Well, it is obvious by now that our kindness was just "used" again to take advantage of me and my wife. After the "Boundary Line Agreement" was signed, Tom Boone began calling his surveyor, Analytical Surveys, in which they began manipulating the boundary line placement over and over. The markers began to disappear and Analytical Surveys would come out and inch over more, despite what was agreed upon in the Boundary Line Agreement. Morover, they came out so many times that I lost count. And they even placed two (2) of their own markers in the SW corner of my property next to each other.

I called them to complain and asked them "just what marker is it, and that you have to remove one and you can't place markers all over wherever you want, next to each other??. Then, where an original pipe was placed in the NW corner of my home in 1936, Analytical Surveys and Tom Boone decided to inch over more onto my property violating our boundary line agreement, and thus repudiating it. And all this time prior to the signed "agreement" this iron pipe was never and issue. How suspicious!

It is very interesting as to why all this survey activity and moving and replacing iron rods "after" the Boundary Line Agreement is signed. Just Greed and fudging to steal more property after a kind act was done to hold peace with a this neighbor. I questioned Analytical Surveys again, and complained and requested that this newly iron rod in the NW corner of my property placed by Analytical Surveys to be removed, and from what I understood, Tom Boone in a telephone call from Analytical Surveys said that "there was some granting of this by the court and a decision was made by Judge Cox, and so on and blad-blah-blah..

Well there was never a decision by Judge Cox or a "big" court decision, it was voluntarily made by my wife and I. Tom Boone had written up this "agreement" and it was signed by my wife and I and he picked it up from my home. Analytical Surveys has apparently fraudulently disobeyed this "Agreement" and has placed markers, removed them, up and down so many times that I question their ability to do surveys. I will be filing a complaint about them with the Texas Land Surveying Board.

Moreover, my surveyor, Global Land Surveying, placed this original boundary at the 1936 pipe where I pulled a string to place a new fence. Moreover this iron pipe was agreed by all parties prior to the signing of the "agreement". But somehow, after the signed "agreement", iron property rods started to appear from Analytical Surveys that inched over more and more onto my property. I believe this is gaining illegal title to my property.

Analytical Surveys needs to stop playing games with property lines and a "neighbor" needs to be grateful for a good deed done by my wife and I. I will pray for you that peace will be with you and that the Lord brings peace for you.

Sam...

Sounds like a sticky situation. However, as a lawyer in Texas, and an acquaintance of Tom Boone, I don't think all the facts you presented are correct. I understand you are angry. But it sounds like Tom was just trying to be a good son and protect his almost 90 year old widowed mother.

That family gives more to their community than any other family I know. I can't see Tom doing any of the alleged acts. Make sure your reports are bias free please.

On Tuesday, October 28, 2008, the Town of Highland Park ("Town") received Your Request for public records and that correspond to the following statement posted on the Internet in August, 2008:

"......According to the Highland Park Police Department, Sam calls complaining so many times a week they have officers near that area at all times on "Sam Duty." They feel pressure to investigate all insane complaints because if they do not he will either sue them or file numerous grievances against them."

In Your Request, you asked for:

(1) Any and all times, dates, and writings that I have threatened to file a lawsuit(s) against the Town of Highland Park and/or the Highland Park Department of Public Safety to August 31, 2008;

(2) All dispatch calls to the HP DPS from me and/or my address to August 31, 2008;

(3) Any and all times, dates, and writings that I have threatened to file grievances against the Town of Highland Park and/or the HP DPS to August 31, 2008; and

(4) A complete HP DPS duty log of all officers in and around close proximity to (****Avenue) at all times of the 24 hour day to August 31, 2008.

On October 31, 2008, you and I conducted a telephone conference to discuss, among other things, Your Request. You understand that for (1) and (3) above, no such records exist. Allow this correspondence also to confirm that I interviewed public safety officers, two (2) street supervisors and a shift commander--none of whom have ever used or heard of the expression "Sam Duty."

Well, thanks for your eloquent false statement regarding the Highland Park police dept. I just happened to call the Town Attorney and facsimiled your statement to him. Guess what? Neither the HP Town Attorney nor the HP police department know what you are talking about. Further, under the Texas Open Records Act, I have requested documents that show what you have stated on this blog to be false. Pretty funny that you lied! again! I'll sure upload the letter from the HP Town's atty for your delightful review. Sooooooooorrrrrrrrrrryyyyyyyyyyyyyyyyyyyyyy!!

According to the Highland Park Police Department, Sam calls complaining so many times a week that they have officers near that area at all times on "Sam Duty". They feel pressured to investigate all insane complaints because if they do not he will either sue them or file numerous grievances against them.

Also how can you say that the Boone family was stalking you? You live next door to their family. Remember the sweet 87 year old woman who lives alone.

I have heard of the Boone family and only hear wonderful things about them and how loyal Tom Boone is. Please leave this generous family alone.
