I ordered a rebuilt transmission for my 1996 Suburban.  I prepaid via check (big mistake) and now know why they won't accept credit cards.

The transmission arrived late. Once received it was professionally installed but operated properly for only 10 miles (3rd gear failed).  The "fix" that Toms River suggested, (add some Lube Gard) did nothing.

The company would not refund the purchase, and would not send a replacement.  Their policy "no exceptions" was to have me remove the transmission and send it back to them all at my expense.  They would pay for nothing.  I pressed the issue with the owner J.R. stating that if he continued to tell me to "pound sand" it would result in legal action.  His response was "I look forward to seeing you in Toms River for the lawsuit. My attorney, who is my sister, looks forward to it.

Do you want to do business with this guy?  Learn from my mistake. Stay away from Toms River Transmissions.

Rick Hofstetter of Santa Cruz,
You are making a bad situation much worse. By refusing to return the transmission, you're not giving the company a way to honor their warranty.

That you are so reluctant to return the transmission speaks volumes.

It has now been a few weeks since my Toms River Transmission failed after only 10 miles.  Since the company would do nothing, I filed a complaint with the BBB.  After that, Toms River would not even respond to emails.
The proporated owner, "JR" to this day remains unwilling to even provide his actual name.

I have since had my old transmission rebuilt and installed by a quality provider.  My Toms River Transmission now sits, unused, a non functioning pile of junk.

Apparently Toms River Transmission knows they can sell defective product and simply walk
away while keeping your money.  As it turns out the BBB has no real "teeth" and Toms River
seems to know the only recourse anyone has is expensive legal action.

Unfortunately I did not know how this company conducted business before ordering from them.
If you have read this, you do.

We are to just send another transmission because you said ours is no good. That makes alot of sence.

I ran into a similar problem with a compurt i bought for the same amout of money. They said please return the previous one, then we will either repair or replace it. By the way, shipping was not covered. We need to have the first transmission back to be inspected.

Not the Whole Story From Toms River Transmissions

J.R..............tell the public the entire story.  I didn't want to keep your transmission.
I don't want something for nothing.  I agreed to send your defective product back if you would send a refund.  You said no.........period.  I even agreed to "eat" all the labor costs of removing and reinstalling a transmission purchased from a more reputable company as my penalty for deciding to do doing business with you. I suggested you send a replacement (a swap) you said no.....
period.   You said I was bound by your terms of sale (burried deep within your web site) even though I didn't use your web site to order and never agreed to any of it.

There are quite a few soiled postings about your company and the way you do business.
Who would believe they are all without merrit.  What's ever wrong about doing the right thing?
You might try it sometime.

tells you the impressive reputation of this company. We strive to solve all problems with customers and tried to do so in this case.
The customer was to return the transmission to be inspected, under the terms of the warranty, but refuses to do so. There is no way we can determine any problem without opening up and inspection the transmission internally.  Without doing this we can not even determine if there is a transmission problem. He wants us to accept his opinion and HIS mechanic's opinion its an internal problem with the transmission. Perhaps it is, but we need to inspect the transmission to confirm this.
Many outside factors can cause a transmission not to function properly.  Computer related, wireharness, bad ground and improper installation are some of these factors.  Proper procedure in installing the transmission is just as inportant as a proper rebuild. Converter must be installed properly,  cooling lines must be completely flushed as well as other factors can cause problems to the transmission.
Without inspection the transmission we can't even be sure there is a transmission problem. Perhaps the customer want to keep a working transmission and also get his money back.
Having an attorney in the family helps conciderably in dealing with such problems. I am very proud of this and we talk often on many matters.
As for credit cards there are many scams on the internet concerning them. We once delivered a transmission, paid by stolen credit card, and lost both the funds and transmission. We will not get burned again.
I look forward to my day in court and telling the judge, we were never given a chance to inspect the transmission to determine if there even was a problem to begin with.
Sincerely,
Toms River Transmission
