I have never felt more ripped off in my life. All of the fees I was charged made it impossible to pay for shipping supplied and postage's as well as more items to sell. I sent a cancel request for my partner auctions only to receive back an email from TH email provider stating that help@tophatter.com reached its max capacity and inst able to receive any more messages. I even contacted Samara from TH who knew I needed to cancel the auctions yet they were not ever canceled and I had to refund a lot of people, offer free stuff to save my reputation which didnt work hardly, and any arrangements I did have with customers was completely ruined once TH took it upon themselves to open cases. I had buyers very upset with me that TH acted for them and that they were ok with the wait and our arrangement. TH refunded customers who I did have arrangements with and left me with a lot items to sell which I was forced to purchase. This has been a nightmare. I will take responsibility for the fees for The September 12th Auction Titled: Keep Calm Put some Jewelry on where I made a whopping 10.00. The September 27th Auction Jewelry and Dinner was UNSATISFACTORY and when I told ELIZABETH she told me to email help...I did and the told me to email Elizabeth. The One of a kind on OCT 11th, American Jewelry on Oct 18th,  and the Surprise Auction on October 21st were supposed to be canceled per my request that was sent 4 days prior to the One of a kind Auction held on the 11th. And another email was sent  on OCT 14th, and on the 16th. All emails were returned with no response! Auctions were not canceled and I have suffered great damages due to this negligence. I have been so affected by this that I have been forced into a depression as affecting customers negatively is not my model in this venture. I expect to pay for the fees for items delivered. I do not expect to pay for all other fees you have charged to my account aafter the Sept 12 and 27th auction with the 27th auction fee to pay are those with a delivered status! This was supposed to be fun. It was supposed to help sponsor lower income kids to be able to play sports when their parents couldn't afford to. TH has not only destroyed my reputation on here as a seller but also as a member of my community here. I am disappointed and so are 10-12 children who didnt get to play. IN ADDITION...I have labels that still need refunded.  In addition I should not have to pay listing fees for the orders that were canceled due to tophatters Security issues.

 

 

It states on your page "Tophatter Seller Protection does not cover orders shipped after an order is placed in a Pending Verification status.  If we suspect a transaction may be unauthorized we will place an order in a Pending Verification status and ask you to hold the shipment.  If we confirm the order is safe, the Pending Verification hold will be released and you’ll be notified you can ship it.  If we determine the order is unauthorized, we will ask you to issue a refund.  If you ship the item while an order is in a Pending Verification status, it is not eligible for Seller Protection."

 

I have yet to feel protected. I also want fees refunded in full for all items that were "unscheduled" by tophatter due to anothers opinion and lack of evidence.

 

To request a refund, please contact Elizabeth directly via help@tophatter.com & in your request, please include:

 

- Email subject line: 'Partner Auction Guarantee ATTN Elizabeth'

- Name of auction

- Date & time of auction

- Reason for refund request

 

There are conditions in order to be eligible for a refund:

 

Requests must be made within 1 business day after the auction ends (ex. If the auction ends Monday at 5pm PST, the request must be sent in by Tuesday at 5pm PST).

Refund requests for an auction must be made by the main host only (refunds will be issued among st the individual co-hosts should they qualify).

All sales made in the auction must be honored and fulfilled; refunding a customer without their consent would automatically disqualify the auction from being eligible for a refund.

 

Please note that requesting a refund expresses to Tophatter that you may no longer be interested in participating in future partner auctions. We want to ensure that you are completely happy with your partner auction experiences on Tophatter.

 

 

Elizabeth knew the situation yet still has refused to acknowledge the issue. Her abilities consist of threatening someone for not being able to fill auctions, to cancel orders because my shipping inst updated and attempts to collect is probably her best assets. Edward requested me to send emails and I will. I have also created a video showing everything that has happened. TIME STAMPED PROOF of my cancellation attempts, Staff messages, as well as messages from customers who appreciated my honesty about the situation and happily waited for their items only to find their accounts refunded by TH and my ability to sell suspended until I pay 500 in fees. I spent 485.56 alone in item charges...in addition I am supposed to pay for Auctions I needed to have canceled and an auction which had so many cancels and security alerts my sales plummeted. 

 

I have been charged 2.04 for shipping labels while TH takes 30% of what I sell the item for including my shipping charge which covers shipping supplies. WRONG. That is not ok. You guys already know it. I see tracking stopped and refund given on an item I sent and still haven’t been paid for. There is a refund Deduction of 7.09 for an item that I shipped to the customer already.  I have been charged for unscheduling done by TH and charged an EARLY BOOKING FEE as well as the hidden processing fee. If I paid 480 for items...2.04 ea item estimated at 204.00 with a 2.00 listing fee no matter what I tried to do to cancel auctions. I am not CHINA. I am American. I don’t sell stuff for .99 with free shipping because that isn’t realistic here and my items are pre inspected for QUALITY.

 

BASICALLY I will pay the amount of for...

 

 The Auctions on

September 12th of 50x 2.00= 100.00 for listing items+2.04x19= 38.76 for labels...and 12.00 for processing fees totaling 150.00. and for 1 5.00 REFUND! I am only responsible to pay the one as that was an item I received payment for and never for any others!

 

September 27th Auction UNSATISFIED HIGHLY! Sales, Excluding Shipping: $217 Paid Sales, Excluding Shipping: $137 MINUS 158 to list 78 ITEMS= -21.00 without costs of items or supplies!!! I lost 5 hours of time and around $80.00.

 

THE REST of the auctions I will pay for shipping of delivered items and listing fees associated with those Orders ONLY!!

 

This is not a negotiation but a demand that you update my account accordingly so I can pay for the fees I am responsible for. If there aren’t changes made to my account within 14 days I will meet again with my motivated attorney.

 

Treat your sellers better.

 

PS I do have a file which contains all interactions and attempts to communicate with tophatter upon request from a leading party at TH or TH attorney.

 YOU chose not only the medium but the path YOU took. YOU could have CALLED them once you realized the email couldn't be sent, but you DID NOT!!! So instead of admitting that YOU made the error, YOU turn it around on THEM!!! YOU agreed to ALL of the terms and conditions of using THAT site so YOU have no one to blame BUT yourself in this instance. Grow up and ACCEPT that YOU dropped the ball by ASSUMING. The ONLY person that has screwed YOU is YOU!!!! Maybe instead of wasting your time WHINING about something YOU had 100% control over, YOU could use that energy to better yourself and your situation. Sorry, but sometimes BEING AN ADULT means admitting YOUR mistakes BEFORE you call someone else out on theirs.
