We  carried frieght this company several times no problem - they paid us by ach each time.  But in January of 2015 the
Driver went in to pick up a load of grapes - told it was extremely time sensitive - needed to deliver by a certain time
Loading took forever - moved truck to more than one dock, changed product etc., etc. - finally he was told his truck was loaded and they would go get his paperwork - he mistakenly assumed they put the correct amounts on the product quantity.  The shipper sealed the truck.
Seal was  broken at deliver by the receiver - cargo short - delivery said should not be a problem - seal was not broken.
A few weeks later we receive a claim - which we are told they are being nice to us because of all the confusion we only have to pay half of due which is 1968.00 but we never had the product why should we pay?  We deny the claim they file a claim for us “stealing” the product on our cargo insurance - without our knowledge.  But our insurance company refuses claim after they hear the facts, then TQL takes the money from our bank account and even refuses to give it back when our bank says they should not have it.  This company is a RIP-OFF!!  I even have an email from one of their employees who state they know we did not steal the product!

We respectfully disagree with your posting.

 

The driver did not count the product and verify the amount before loading, which is not in accordance with the carrier contract signed by your company on 11/11/2014, which states:

 

“By signing the bill of lading, CARRIER is confirming that the correct product and correct product count were received at the proper temperature. CARRIER is solely responsible for loss or damage incurred due to inaccurate product information on the bill of lading. If a discrepancy as to count, condition, or temperature is encountered at the shipper, CARRIER shall notify BROKER immediately, and no change to loading information shall be made until confirmed in writing by BROKER.”

 

We reviewed all communications available to us and confirmed that there was no evidence the product shipped in an amount less than what was on the bill of lading. The claim has been validated for the reason of “shipping short”, not accusing anyone of stealing product.  If you have any additional information to the contrary please email claims@tql.com.
