Toyota Motor Credit Corperation Conducts Bad Business Torrance California
After returning for a 15 month combat tour in Baghdad, in febuary of 2005. I thought that I would reward myself with a new car.
I entered into a contract with Round Rock Toyota of Round Rock, Tx. to purchase a 2005 Seqoiua.
Since i was in the Army at the time i made it known that i would be making my payment by Army Alottments. what this means is that my truck payment will be payed with a check from the U.S Treasurey department check. the money would be automaticlly deducted from my paycheck monthly before i would even get paid.
Remember, the checks that they would receive will be coming from the treasuery, and it is the same check that you would get when you get a tax return.
The first payment was due on the 6th of april of 2005. I called toyota to ensure that the payment was on time and credited to my account and all was well.
upon retiring from the Army after 21 yrs of service in April of 2006 I continued to have the payment deducted from my retirement account so the the payment would remain coming from the same place. At this point no payment were missing.
In febuary of 2007 I received a call from TMCC stating that I was 4 payment behind. They stated that, November and December 2006 payments and January and Febuary payments of 2007 had not been received.
When I called the Retirement Pay Section of the Treasurey they stated that TMCC had cashed the November and December checks that they sent to them, in which they did not credit to my account, and that they had returned the January and Febuary checks uncashed. In addition to the above mentioned checks, while trying to figure out what the problem was, which took a couple of weeks they returned the March 2007 check as well.
I did a three-way call with TMCC and the Retirement Pay Section of the Treasurery to have them explain what the findings were. TMCC denied that they returned the payments, and basically told me that i was just not paying in a round about way. during this ordeal I was threatend by Toyota that they were going to reposesse my truck. i asked them how can you reposesse my car when it is your mistake and i have proof of your mistake. once all of this was fixed i thought that it was done and over. i got the money that they returned to the treasury and sent it to them.
Hold on to your seats its going to get better. In october of 2007 I received another call from TMCC stating that the payments for July, august, september and october payments of 2007 were missing, at that point I flew off the charts with anger and rage, I told them that this is the second time that they have called me stating that payments were missing.
Once again i called the Treasurery Department to have them tell me the same thing again, TMCC returned the payments back to them uncashed. Again I did a 3-way call with TMCC and the pay section of the Treasurey and again toyota denied doing any such thing.
I spoke to numerous attorneys and they all said that there is nothing that I could do to them and they said that i will have to just deal with it because i am under contract.
I stated to all these attornys that there is two parts to a contract. the part that I have to uphold and the part that TMCC has to up-hold and that it is not a one sided obligation.
During this situation i have asked for a written statement to why they woud return checks for payments on accounts and i have yet to get a response.

Filed a law suite in reference to the matter at hand. It took a while to find an lawyer that would handle the case. I called over a two dozen laywers and all of them basically stated that Toyota could do as they pleased and that there was nothing that I could do but just follow the rules of the contract.
I told all of them to get bent. Just because toyota is a large company they dont have the right to do as they please. The last time I checked there are two parts to a contract. Meaning, what I have to do and what they have to do. So, stay tuned for the end results.
It has been 8 months since I started the process, I feel that they are prolonging the process due to the proof that I have. This is a frustrating process and I am more than willing to wait it out.

I understand your frustration against the GROOSS INCOMPETENCE and ARROGANCE that is being displayed in your situation. Read my reports here on ROR against the Tropicana - PepsiCo - Frito Lay - Quaker group of companies and what it takes to fight these huge outfits.
The FIRST thing you want to do right away is STAY OFF THE PHONE!! You MUST document everything if you expect to prevail. You have recourse and can sue for big bucks, but you MUST create a "paper trail". Phone calls "never existed" when it comes time to go to court.
Now, SECURE your vehicle RIGHT AWAY. Keep it in a garage, install an alarm system, use a boot, whatever. Secure that vehicle so someone will have to take a lot of time and make a lot of noise getting it off, so you can catch them in the act.
Communicate ONLY in writing, and ONLY by certified mail, return reciept requested.
Be sure to put the certified # at the top of each letter and keep a copy of each for your records.
By the means above, IMMEDIATELY order your credit report from all three credit bureaus. You will need these to prove damages when you sue them.
Also, by the means above DEMAND a full account history from Toyota and also dispute the fact that you have ever missed a payment.
By the means above, contact the federal government and request a copy of your payments made to Toyota, as well as proof that checks have been returned. Get an itemized listing of checks with dates sent and dates returned.
Now, file a motion with the court for a RESTRAINING ORDER to keep them from repo'ing your vehicle, after presenting evidence above.
GO PUBLIC!! Get one of those Investigative consumer reporters to get your case on the news!
Have fun with these idiots and do as much damage as you can.
