Complaint Review: Track-Backs

On 12/02/05, I ordered a Black Large Kasey Kahne racing jacket on track-backs.com, by accident. I meant to order an Extra Large. I received it in the mail on 12/05/05, and realized it was the incorrect size. The merchant left a business card on the top and I called and spoke with Tom.

I informed him of the accident, and he informed me to send it back along with a $25 check or money order ($12 for his shipping back, and $13 restocking fee), along with a letter stating what I needed. I mailed it back the following day.

I received my exchange on 12/17/05, and it was an XL Red Kasey Kahne racing jacket. I specified a Black XL Kasey Kahne racing jacket in the letter Tom told me to send.

I contacted the merchant and kept receiving a voicemail stating that they were busy for the holidays, and to contact them via e-mail. I sent an email, and he kept insisting that I did not specify a color, which was incorrectt, and they only had a Red XL

Thomas Bietz merchant is refusing to refund me all my money. He is saying that he will refund me $74.94 (cost of jacket 99.94 minus $25.00 restocking fee).
