I contacted Tracy Moore because I just finished up my debut album with features from MMG, Engineering from Grammy award winning engineers Gustavo Celis, Ray seay, Matt Marrin, Ariel Chobaz to name a few and mastering from Herb Pump Powers jr, the best mastering engineer ever. So I reached out to Tracy because I wanted to get a good push behind our lead single by the Core DJ'S.

So Tracy tells me I need to come to Las Vegas to the Mixshow live/ core dj retreat that they have every year... She says this will be a good opportunity to expand. She told me the cost would be 5000 but since it was so earlier before the event was scheduled to start she would break the 5000 into 3 payments leading up to the time of the event.

So I ask, what exactly is included in this 5000 because I wasn't particularly looking for a trip or event, I was mainly looking for promotion of our lead single.. But since she said its a good opportunity I was curious to see what it's about. So I asked what exactly happens once I pay the first payment. This is where the lying and providing misleading information begins.. (And I have it all in writing to prove) what I am saying!

So she says once you send over the first payment, this is when you'll start getting all the dj feedback (she said my single would be serviced to all the core DJ'S including Tony Neal and they would all provide me feedback on the record) this is a very important part of promoting a single.. It allows you to know how the DJ'S feels about it and what they think it can or can't do. So the first payment was for 1500 dollars and the dj feedback is what I was suppose to get once I paid it, as well as a conference call with all the DJ'S and member who would be working on the promotion for us so we can all be in the same page... The second payment was scheduled for a little over two weeks after the first payment. So I send over the first payment which is 1500 dollars.

So now a little over two weeks passed and it's time for me to make the second maybe so I contact Domonique Mack (which is Tracy's assistant) Tracy would no longer even email me back after I sent over the 1500 dollars, instead Tracy's assistant started to write me. So I let Ms. Mack no that I'm a little upset and disappointed to say the least... Because here it is time for me to make the second payment and I have t even got anything I was told I would get once I make the first payment. So now it's time for the second payment and I'm not to excited about paying this second payment because I haven't received anything I was promised I would have by now..

So Dominique tells Tracy about my complaints.. So finally I here from Tracy 469 487-9234, (she calls my phone) and I have been doing business for a while and this has to be the most unprofessional business person that I have ever dealt with. I tell Tracy the exact thing I've told her assistant and for some reason all she has to say is I never told you you would get dj feedback.. I said Tracy, yes you did tell me I would have dj feedback by now.. I have the email Tracy, I can show you. She doesn't want to hear anything I'm saying to her and continues to respond with some of the most sarcastic and unprofessional comments that I have ever heard.

All I was doing was pointing out the facts and she refused to even hear me out. So finally I told her, you know what Ms. Moore don't even worry about it, I'll send you over the email where you said exactly what I'm sayin you said, which is that once I pay 1500 I would start getting dj feedback so you can see for yourself.

So I get off the phone with her and I find the email and send it over to her to see what she has to say now. she sees the email she wrote me... she says i do see where i said that, which i said incorrectly!

Then she goes on to say that the dj feedback is part of promotion and I won't get any dj feedback until I pay 3500 dollars, (the first payment and then the second payment as well) I said Tracy that's not what you told me though. You told me i would receive the feedback once I paid 1500 dollars. Then she says o well let me get that dj feedback going then because I do see where I did say that. I said Tracy had you listened to me while we were on the phone you would have known that but you were so busy being nasty as you can possibly be to me on the phone like I was lying about what i was told or something.

If you would have treated me with respect instead of treating me like I'm a fool or something then maybe I would be willing to continue this process but since you have no sense of customer service plus now the timing is to late, i was told i would have the feedback by a certain time and that time has came and went and now i cant even do any of the things i was planning on doing so I do not wish to continue this process and I don't have to.

I have not received anything from you or your company as of today. I paid you 1500 dollars based on false and misleading information that you admitted to yourself by saying you did say that incorrectly and then you treat me like a dummy on the phone. I do not wish to continue this or any other business with you or your company, you have horrible business practices. I have not received anything that I was told I would have by now and you have admitted to giving me incorrect information therefore I am not bound to any contract with you and I would like to have my money back.

Then she finally starts to act a little nice, she offers me alternative promotion services and I decline because I would have to question the integrity of anything that you or your company would do for me after this disagreement and the mean comments you said to me on the phone..

I do not wish to to do any business with you! So no I don't want anything from you but my money back, She then says yea I do see where I made a mistake but you can not have your money back, we do not do refunds!!!

I said Tracy yes you do give refunds because you made all the mistakes in this deal and I am not bound to any agreement because you used false information in order to secure a contract, admitted to it and now your telling me I can't have my money back?

thats was over 2 month ago and I have not heard from her or any of her assistants since!

She basically took 1500 dollars from me and ran!!

Be aware!! Bornstarz Inc, Mixshow Live LLC, The Allstarz Group she is the manager of The Core DJ'S. be very careful with your money! Horrible business ethics!

My email to Tracy: 
 
I'll have the payment to you Thursday night (tomorrow) so we can began promo Friday morning.. Is this okay? Sorry for the delay... These banks take forever sometimes.
 
Tracy's email: 
 
Promo won't begin until after the second payment is complete. The initial payment will begin the dj feedback. I'll give you a full schedule once the initial payment is made.
 
After this email I sent the payment because I was told by Tracy that the Dj feedback will start. I will start getting the feedback from Dj's, which is very important, this is what made me send the 1500 dollars.. Otherwise I had no incentive to send over 1500 dollars, I only sent it because what Tracy said will happen once I sent it, which is my Dj feedback will begin, as well as a confrence call with all of the Dj's. 
 
After I sent over the payment and waited a reasonable amount of time I contacted by Tracy by phone to ask her why the feedback and conference call has not happened and this is when she basically told me I didn't know what I was talking about and I was wrong and she never said that to me and that the Dj feedback comes after promotion so I would have to pay another 2000 additional dollars before the Dj feedback began.
 
I told her how is this possible? 
 
If you initially told me I would start gettin the Dj feedback once I paid 1500 dollars, which i did pay. After I paid the 1500 dollars now your telling me the Dj feedback comes after promotion and I would have to pay you another 2000 dollars before the Dj feedback begins???
 
 I told her I would forward her email to her for her to read.
 
Then I forwarded her that email above for her to read her own words. 
 
Then this was her response: 
 
In this email I explain that the dj feedback comes with the viral blasts which won't come until the next payment.  But I do see the email where I said that you would start getting feedback which "I said incorrectly" so I will make sure you get feedback this week.
 
Now keep in mind this is after I had a horrible phone conversation with Mrs. Moore, if she would have spoke to me with the slightest bit of respect instead of insulting me as if I was a liar or something, I may have considered doing an alternative service. However, that was not the case, Ms. Moore spoke to me as if I was nothing but a ignorant person and I didn't not understand my rights. 
 
Since that was the case, I politely told Ms. Moore no thank you now, I do not want any feedback to begin nor do I want any alternative service from you or anyone in your organization, I would have to question the integrity of anything you do for me after this, so no I don't want any ulster native services. 
 
You provided me misleading information in order to secure a 1500 payment. I sent you the payment and then you admitted to me that you did provide me false information in order for me to send you 1500 dollars and now your telling me I can't have a refund?? 
 
I can't have a refund but you are willing to offer different services now? 
 
You admitted to making a vital mistake, a mistake that was the reason for me sending you the 1500 dollar payment. You admit to your mistake and then say I can't have my money back?
What type of business ethics is this? 
Is this not fraud? A scam? What's the difference?
 
explain to me why, under these circumstances that I am not entitled to a refund of my money?
 
Also please keep in mind, I respectively called and emailed Tracy about this matter numerous time and she continuously ignored my calls, text and emails.
 
She finally wrote me a email just now offering me another service but not my money back. the only reason for her doing this was so she could write on here that she offered me an alternative after five months of me trying to contact her. Trying to make it seem as if she has been trying work this matter out... Which couldn't be further from the truth!
 
If you are an indie artists that trying to make it be careful with your money, they are sharks. They use big artists and Dj's names in order to get you to think that they can help you out and that they are here for you, the minute you send them money they treat you like a trash. This is from my personal experience!!! I'm speaking from experience! I can't speak for everyone but Ms. Moore has the worst business ethics that I have ever dealt with. 
 
I have even went on the limb by offering Ms. Moore a settlement price, a discounted refund. I even told her we can split it into payments over time of all the money isn't available. She still refuses to give me my money back. 
 
All I wish to do is settle this matter but Ms. Moore is under the mistaken impression that this will be swept under the rug and I will just let this one go. I'm sorry but justice must prevail.
 
I have all of the emails, that I would be more than happy to provide anyone who wants to see the entire story and when this case goes to court, I will provide an update.

The disclaimer on the agreement for the event that this customer paid for states: 

"We look forward to working with you to customize a package that will maximize all of your marketing and promotional needs. If there is something we missed, please let us know.  The Participant Submission Form serves as a letter of agreement. We will begin pre promotion of your brand once its returned with a legitimate signature and 50% of your sponsorship is paid. There are no refunds & you are responsible for your company's brand marketing and promotional materials, however we do have 3rd party vendors available if necessary."

The customer customized a $5000 package and paid his first deposit of $1500.  Once any portion of the sponsorship is paid, it's immediately turned over for the event team to pay for hotel rooms, sound, visuals, etc. In this case before half of the money was paid, he requested a full refund because promotions hadn't started. We declined the refund and referenced the disclaimer.

We've since corresponded with the customer and offered services up to $1500 and an opportunity to attend any of our upcoming DJ Conferences with comped registration and additional benefits.
