Transunion Transunion does not comply with Fair Credit Reporting Act and Gives your info to India. Fullerton California

I called Trans union at about fraudulent inquiries on my report. A young man in India named Richard took my call. I could barely understand him due to his thick accent. I told him about the fraudulent hard inquiries from ALW Sourcing LLC and that I have been unable to get any cooperation from the company. He just repeated I can't dispute inquiries. I asked for his supervisor.

Hazel came on the line and had the same thick accent. She just repeated what the first man said. I asked where she was and she told me she was in India. I almost had a heart attack. ARE YOU KIDDING? MY FINANCIAL INFORMATION IS AVAILABLE TO A THIRD WORLD COUNRTY??? I do not have a problem with people from India, but they are just a little too close to those who wish harm on Americans.

When I asked to speak with someone with authority, she connected me with Mike in the U.S. It was a very bad connection. He just repeated the same thing. When I asked for a manager, he put Michelle on the line. She just kept repeating the same thing.

WE DO NOT DISPUTE INQUIRIES!

I heard this line at least 15 times.

According to the Fair Credit Reporting Act, the credit agency is obligated to investigate everything that I dispute, including inquiries.

611. Procedure in case of disputed accuracy [15 U.S.C. 1681i]

I am very uncomfortable with the fact that my credit information is easily viewed from India. This is not technical support. This is our nation's security. I consider TransUnion a traitor of the United States.

On their letterhead it states Our goal is to maintain complete and accurate information on consumer credit reports.

To that I say TransUnion, you are a rip off

Your issue is NOT with Transunion..Credit Reporting Agencies do NOT dispute inquiries. The part of the FCRA you quote refers to accuracy of account information. You do not specify if the inquiries are "hard" (seen by others when they pull your credit and can impact your FICO score) or "soft" (not seen by others when they pull your credit, and may be for the purpose of marketing, from a junk debt buyer/collection agency, etc. These do NOT impact your FICO score.

What you need to do is send a letter to the companies making the HARD inquiries, Certified Mail, Return Receipt Requested, asking them what is their PERMISSIBLE PURPOSE.

I have noticed that you have placed an inquiry on my _________ credit file dated ________. As you probably know, Credit Reporting Agencies treat inquiries as a statement of fact and will not allow a consumer to dispute them. Since it is against federal law (Fair Credit Reporting Act -- 15 USC ?1681b) for an entity to view a consumer's credit report without a "permissible purpose," I am writing to inquire as to your alleged purpose, for doing so since I did not apply for employment with your organization nor did I request credit from your organization.

Based on the evidence in my possession, this inquiry was performed under false pretenses as described in the clear language of the law. 15 USC ?1681n(a)(1)(B ) states, in part, "in the case of liability of a natural person for obtaining a consumer report under false pretenses or knowingly without a permissible purpose, actual damages sustained by the consumer as a result of the failure or $1,000, whichever is greater;"

You are civilly liable to me in the amount of $1,000.00 for your willful violation of the law -- performing a "hard inquiry" on my __________ file without my permission. I do hope that we can settle this matter amicably. You can remove the inquiry within one (1) business day of the receipt of this notice. Or, we can meet in court where you will end up removing the inquiry, paying me the civil liability fine, punitive damages for my score drop, plus court and attorney fees. The choice is up to you.

If they are "soft" inquiries, you can "opt out", which will stop you from getting junk mail and offers of credit cards, insurance, etc. Instructions on how to do this is on the websites of all of the Credit Reporting Agencies.

I have actually found Transunion to be the most helpful when it comes to solving reporting issues that are within their scope. Unfortunately, they are correct in that they do not dispute inquiries.
