We financed a vehicle through Triad Financial two and one half years ago. We made all of our payments on time with the exception of approximately 5 in the past two years. Those five were made no later than the day after the payment was actually due (the payment was due on the 25th and all were paid by the 26th). On each of those occassions, I had let time get away from me and forgot until 6:00 the next morning.

On one of those occassions, I made the payment at 9:00p.m. on the day it was due using their over the phone payment option. The next morning at 9:00, we received a rude phone call demanding a payment because we were "delinquent" on our car loan. We explained that the payment had been made on the day it was due and had already been debited out of our checking account. The person on the phone informed us (rudely and abusively) that we had a high risk loan and we made the payment late because it was not made prior to 5:00. No where in my contract did it say that we had to have it made be a certain time - only by a specific day.

To top off this two year nightmare, we sold the car on September 18. The dealership contacted Triad on Sept 20 to get the pay-off so they were aware of the trade. Two days ago, October 4, we received another rude call demanding a payment because we were delinquent. We explained the situation, they told us rudely that they were unaware of any change in our obligation to them and we owed a payment.

We told them not to call again and hung up. The next day, I contacted the dealership to say that we were being harrassed by Triad and got the date that the check was mailed to Triad (the 27th). Again, that day, we received another call. After three attempts to get someone to note our account, I was told that we owed the money, we had a contractual obligation to them and we needed to fulfill it. They would not even note our account with the date the check was sent nor would they check with the correct department to see that there was a misunderstanding there.

I was finally transferred to some "supervisor's" voice mail and left a message requesting help in getting this mess cleared up so that we weren't threatened by their rude employees any longer.

No matter how bad someone needs a loan - DO NOT USE TRIAD!!!! They assume that everyone they do business with is a deadbeat and is trying to beat them out of money. To make it worse, every employee I dealt with told me that I had no right to complain about their behavior because they had loaned me money.

Today I spoke with a our State of Minnesota Department of Commerce in the Financial Examinations Division. He gave me some interesting and valued information. It appears that he is quite familiar with Triad. He faxed me our State Statute for OBSCENE and HARRASSING telephone calls. ( He agreed that getting 4 calls in one day justifies harrassment as does the 8 phone calls in less than 24 hours, and calling a second time in less than 2 hours) I got a number for a person that is in the Legal Department. He is the Supervisor. His Name is Sergio Tadilla (not sure about the last name spelling) his telephone # is 1-800-587-4230 at extention 24626.

All I had to do was mention the name of the person from my state that I had spoken with and he is now in the process of getting to the bottom of this. I strongly suggest that each and everyone that has been a victim of Traid in any way shape or form in dealing with their collection practices, to call him. Let's make their phones ring off the hook!!!!!

Description:
Triad Financial is calling me demanding payment on a debt that I no longer own.
I traded the Triad financed vehicle, for another vehicle, at Courtesy Auto on
Sept. 5, 2004.
Triad has stated to me that I have to pay payments to them because the
dealership has not paid Triad Financial the final pay off, due to the dealership
taking up to two months to get pay off to Triad.
I am being harrassed by Triad to pay for a debt that I no longer own. Triad
calls my home 3 to 4 times per day, demanding payment, telling me that I am
legally bonded to their contract until the dealership gives Triad the pay off. I
have not owned the vehicle financed by Triad since Sept.5, 2004.
Satisfactory Solution:
I have never dealt with anything like this before. I do not believe that what
Triad Financial is doing to me is legal. I would like to prosecute Triad
Financial, and have the courts hold them accountable for their fraudulent debt
collection activity.

Triad responded to my complaint stating that they contacted Courtesy Auto World, and Courtesy Auto World is being less than cooperative.
I am now in arbitration, AUTOCAP.

Triad is the ABSOLUTE WORST company to deal with.
Their phone vultures who called my home, harrassing me, AFTER I traded my car in, have ALL been recorded, and I would be more than willing to share my information with ANYONE who would be willing to take Triad to court for the illegal, abusive collection practices.
