Tribeca Lending and Franklin Management still unproved and alleged only seems to change the Loan terms and Mislead.

Tribeca Lending Corp a subsidiary of Franklin Credit Management according to a search of Federal Lawsuits has been charged with violations of Truth in Lending
and we are looking for any information that could help support this claim as I am a single borrower and could benefit greatly by anyone else whom at least might
feel they have been mislead.

I also got ripped off from tiibecca lending at closing the same thing happened to me. My payment went to 4800 a month are you kidding . I lost my house that I built. It was to be 9percent but at closing it was 13.99 adjustable.

This is not true ... somebody added that i lost my home. But not from me. . i have not lost my home. Furthermore i am in litigation now , and i did not realize, that this is posted. I wish to have this removed. I do not want to get sued , this company is spooky. They are litigation experts and I am not. I had no idea this was posted . I need to have this statement removed.

I found them on Lending-Tree and they had a very sophisticated method for Bait-an-Switch. Thier notary came to my home with documents, halfway thru the signing, claimed they were erroneous (mispelled names) and took all copies. The next documents had not included a truth in lending form, and the percentage rate was switched , and at the time I must confess I didnt notice, as I thought they were just like the first set.

I noticed the interest rate when the docs were mailed to me, as their notary did not leave me any docs at all. This was my first time re-fi-ing so I didnt know any better. The interest rate went from 6.25% no prepayment penalty adjustable , to 11.99 % and a $10,000 prepayment penalty. The purpose of this loan, was to lower my payment from $2400 a month because I lost my job and I wanted to take equity out of the house and use it to live on until I could make more money. I also had bad credit and they knew I didnt have many options.

The new payment 1st bill arrived at $4500 a month and it said I owed 3 months past due totaling $16750.00 for the very first invoice.!!! I consulted an atorney, and learned a cardinal rule.. while he could "bully" them a bit I really had no legal recourse, because I technically didnt pay them any money (yet). So even though Bait-and-Switch is against the law , there was no "mortgage police" to go apprehend these theives(so to speak). I ended up having to sell the house as I couldnt get out of the stupid deal with them completely, unless I took it to court and that would have cost a ton of money, I am sure they countedon this. I did however,only pay the for 2 months total over 11 months, and I had to pay $5000 prepay to get out of it.
The one thing that has really bothered me since the beginning, was that the Notary's signature on the forms , was alone on a completely seperate sheet of paper that my signature was on. The attorney and several Real Estate Brokers have since told me this is not unusual... Well what is the point of the Notary being in person if the signature can be isolated, it defeats the entire purpose of making sure all parties are there signing the same docs at the same time.

The person at Tribeca whom handled the loan was Named Ken Vessley. I would love to be involved in any Class Action Suit , of if nothing else I have my loan docs which may be of use to someone else who might be able to use as evidence or my testimony. I really would love to see these people go down hard. I reported it to everyone I could thinkof and never even got a "Thank you for your report" letter much less follow up. Oh also, I think I stil have screen shots of their original online offer of 5.85% and then 6.25% loan offers, which of course prove that the 11.99% was never offered it was switched. Oh one last item Lending tree did absolutely nothing what so ever when I reported to them about these leeches and further I applied for a loan info on lending tree ,after the fact to se if they would indeed again offer a low rate to get my interest , and they absolutely did.

Please let me know either way about anything on this case. Good Luck with your lawsuit. You may have just found your self a star witness!!
