Reselling Our Subliminated Hockey Jersey Logo and Artwork as their own!

 

This company; Triumph Apparel is part of Triumph Corporation in India by two brothers Sanjay Rana and Rahul Rana were hired in 2007 to screen our team logo and images onto our team jerseys we ordered through them.

We did not sign off to have them re-sell our completed jersey as their own product seen here:  http://www.go-battle.com/deercamp.asp

 

The front crest logo, the bullet holes, the colors and layout are all of our own thrown onto their Bucks camo jersey.

Contacted once they said they did not sell any of these jerseys but we asked that the product be taken down so it was not reused without our authorization.  We asked nicely but still our Dear Camp subliminated hockey jersey is up and live and selling to the general public.

 

  • It is our own design, we paid for inhouse, not outsourced
  • It is our dead dear logo, we paid for inhouse, not outsourced
  • It is our team name
  • We have the original artwork that was emailed to them
  • We are wearing these jerseys with orange helmets
  • We never authorized the reuse or reselling of this jersey or artwork
  • We received no discount

Updated info:

Read their reply email in 2010, see our opinion inserted today in red ink and understand that:

  • We never signed off on publishing our work on their site for sale.
  • They are assuming the right to show our jersey on your Hockey Jersey Product listings for sale because we chose the cheaper price on buying jerseys, that is not the same as OKing this publication and reselling of our jersey, logo and image asssets.

 

Deer Camp,

As a manufacturer we reserve the right to publish any of our work on our site. Your order was placed in August 2007 which was 3 years ago, I was able to retrieve our e mail conversation which is copied below and self explanatory.

 

  • Since you are already carrying our website on your Jersey I don’t see the issue displaying the jersey on our site.  Deer Camp 2013: (We never approved having it listed as a Product For Sale!!!)
  • In your below e mail you had mentioned you will be sending out a team picture and testimonial which was never received. Deer Camp 2013: (Then we would bee seen here:  http://www.go-battle.com/triumphstars.asp and we said we would if, they removed the jersey from the Sublimated Hockey Jerseys For Sale page)
  • Your team got a price break as well as free shipping under our sponsorship program.  Deer Camp 2013: (Then we would have our jersey shown here:  http://www.go-battle.com/triumphstars.asp) not here http://www.go-battle.com/hockey.asp?pageno=3
