My wife and I bought a car from U Park 'Em U Sell 'Em last year. It was a 1994 mercedes that looked very good. My wife asked if it had ever been painted, because it looked so good, and she was told directly that it had not.
U Park 'Em U Sell 'Em, acts as an intermediary for the seller, however, there is no direct contact with the seller permitted. Therefore, you have to depend on the intermediary to represent the truth.
We recently decided to trade in the car to the Mercedes dealership. Their body shop assessed the car, and told us that the car had been wrecked down both sides of the vehicle, repainted, and that the bondo was so thick, that the paint meter would not even register the metal. As a result, we lost at least $8,000 on the trade in of the car.
The mercedes dealership has documented the extent of the damage for us and also told us that it is a state law in Georgia that dealers must legally disclose this type of information. I have not taken any action on this as of yet due to the economic and emotional frustration involved. If your web site can help us, we would appreciate it. Please help us get our money back. CONSUMER TIP:
Besides Georgia, it is a state law in most states about disclosure. The problem with this, is if someone else sells the car who doesn't know the vehicles history. This is normally why a seller will have a company like "U Park Em" sell their car.
We start to get into a gray area, because I assume that "U Park Em" was not the legal owner of the vehicle and probably knew very little about the history of the vehicle.
You might check to see if "U Park Em" has a dealer license to sell cars. If so, many states have an 'Implied Warranty' which might help you when a vehicle is sold by a dealer.
Did you check this vehicle against Carfax.com which could have told you about the previous accident damage?
NOTE: Whenever purchasing a used vehicle, always have a mechanic check the car beforehand!
