Carhop commercials sound so friendly don't they? Well if you like Mafia style collections Carhop and UAC are for you!!

I'll admit my part, we were behind on a payment (due to a bank fraud on my wifes account) but had made payments since the "missed payment". All of a sudden people from our "references list" (Friends/Family/co-workers) were getting numerous harassing phone calls, sometimes 5 in an hour. Even though UAC had both my wife and my cell number.

The thug who we delt with is called "Brian". Brian called my mother constantly and asked "Why don't your children listen to you?" Upsetting her.
Brian called my friend and told him "I haven't heard from (Insert our name) in a while and I'm really worried, could you call and check on them?" My friend called us in a panic thinking something had happened to us. My coworker got 5 calls in 1 hour. They also called numerous times at both my wife and my workplace even after being told we couldn't accept these calls at work.
I sent a letter to UAC telling them to stop harassing my friends and family and to stop calling my wife and my workplace. I got a e-mail back saying pretty much "pay up and we'll stop calling your family" (Nice Mafia like tactics UAC) The calls kept coming to friends and family and workplace, Brian still being rude to everyone. I sent a 2nd letter this time demanding the harassment of my friends and family and workplace stop. Still the calls continued.

Finally I get a call from a woman at my work, I tell her I can't talk to her while I'm working, she goes off on me and I finally snap and tell her to come get the car, I'm tired of all the harassment. UAC's Repo man shows up and tows the car. They then call the next day telling me for $800 ($500 plus their $300 repo fee)I can have the car back, I tell them to pretty much go to hell.
I call the repo company to get our stuff out of the car, they want $40 for ME to pick up MY stuff. They can keep the $10 worth of crap in the car.

I've contacted a lawyer due to UAC's blatent violations of the Fair Debt Collection Law, and I tell anyone who had to deal with thier tactics to do the same.

AVOID UAC/CARHOP AT ALL COSTS!!!!!!

They called my wife and told us "We sold the car for junk for $100" (The car is in perfect working order and has no damage) well we drove by today and sure enough its in the lot for sale. Liars, theives and cheats, every one of them.
I don't know how they stay in buisness.

They sell it for less that its worth thats their problem. I'll fight it in court, and counter sue for harassment. It'll be a cold day in hell before they get any of my money.

The Fair Debt Collection Practices Act(FDCPA) does not apply to the Original Creditor only 3rd party collection agencies. I am not 100% sure with this company but if you still had the car it sounds like UAC is the original creditor. If this is the case then any number of letters citing the FDCPA will get you no where.

Now, if they are a collection agency did you send these letters certified mail with return receipt. This is the only proof that a court would accept as to if you did notify them. A regular first-class letter would not be proof. If you did this and they continued to call then yes you would have a valid suit against them. But you don't need a lawyer you can just file a small claims case against them.

I know you were upset but just be aware that even if they reposessed the car you still owe the balance of the loan after the sale of the car. So if you owed 10K and they sold the car for 4K at auction you still owe the 6K plus the fees involved in the Repo and sale. If you do not pay it they can take further action against you. One of these actions may be filing a suit for the deficency balance. You may have found that paying the $800 and keeping current was actually worth it in the long run.
