Much to my surprise in March of 2006 a server appeared at my door at 8:30p.m. with a Citation filed in Nueces County on an old credit card account. This account was charged off many years ago and was transferred from Bank to Bank.

There was no correspondence from anyone including the said company Unifund CCR Partners. Most of my creditors have worked out arrangments for repayment which I would have been happy to do given the chance.

This company is a rip off and they are suing for $13M+ dollars including attorney fees. They won't even try to work out an arrangement to pay.

In my opinion they look for old charge offs to make their money. The government should do something about them and many credit card companies. Bad things happen to good people and rather than kicking them when they are down, they should try to give them assistance.

I have a scheduled court date in February, which is not going to be pleasant much more embarrassing as I know the Judge.

These are junk debt buyers who most likely paid a penny or less on the dollar for this old debt.

Keep in mind that when you go to court, it will be you who determines if they win or not.

DENY EVERYTHING! And stay off the phone!

Do not even acknowledge the old debt as it is only relevent for determining SOL. The original creditor is otherwise totally out of the picture.

Immediately get a lawyer if you do not understand all of the ins and outs here. You can screw yourself real easy without even realizing it.

They must prove you owe THEM the money. They must prove they own or have right to collect the debt. They must prove it is within the SOL for collections. However, they only have to prove these things if YOU challenge them. The court will not do it for you.

This item is most likely past the legal of statute of limitations making the lawsuit frivolous. The SOL in TX is 4 years from date of charge off.
