Unifund CCR Partners is trying to get money out of me that I don't owe them.  Ive never had the account that they are trying to pin to me and it is fraudulent!  This has never been on my credit report either.  Now they say i owe 2500 bucks!  And their lawyer, Michael Keeney, has sent me a letter threatening to take it to court.

When I first recieved a letter from them, I tried to find out what the original debt was.  It was a Citibank Verizon Visa.  I've never owned this card.  I called my attourney general and the better business bureau and filed complaints with both.  I mailed them a certified letter requesting a copy of the original contract, transaction records, and a last mailed statement.  They mailed me back the last mailed statement, but nothing else.

Six months later, i get a letter from michael keeney.  How do i stop these people?  I don't have much money and live basicaly from paycheck to paycheck.  To my knowledge the statute of limitations is up anyway.  There should be a law against people like this!  Any help would be much appreciated!

My husband was also a victim of these sleazebags.   Unifund buys bad debts from credit card companies and other firms who claim, for whatever reason, that a consumer has not paid them.  Very often, these companies have already written off the debt, so whatever money they get from Unifund is basically gravy.  Unifund, who then is the legal owner of the "debt," then turns around and finds bottom feeder law firms in the geographical vicinity of the consumer, and contracts with them on a commission basis. That's how they can get so many lawyers working for them. These lawyers then search out the consumers' employers through their SSNs and attempt to bully payroll managers and employers into garnishing the wages of the unsuspecting slobs, who often don't know how to fight back.  This technique has garnered Unifund CCR quite an embarrassment of riches---and they SHOULD be embarrassed because they are scum.


How do you fight back?  Quite simply, you go to court---and face them in court---on the specified date, and tell the judge your side of the story.  You can almost always get the garnishments to stop because judges take a dim view of this kind of thing.  Your strongest point will be that you owe Unifund nothing---they are a third party who basically bought a debt that has already been written off and technically no longer exists. Ergo, they have no legal rights to your paycheck or any portion thereof.
