I have (like others) been victimized by United Auto Credit Corp. My payment fell 1 1/2 weeks behind due to an unforeseen fincancial difficulty. They (of course) started to call one day past due. This is actually per their company policy (which can be found at http://www.upfc.com/UPFC_Investors_Presentation.pdf. They threatened to "Send an agent out to deal with me" if "I didn't pay by the end of the day".

I was told to "Go hide in my closet", that "I am not a man, I am a deadbeat loser". They repeatedly called my at work when I advised them that such contact was not permitted. They verbally abused my wife and children. They have also abused the receptionist here at my company.

I'm planning on making my payment tommorrow and them seeing what I can do, because while the FDCPA does not apply to them (they are not third party collectors), PA has a state law that does apply. Some other states do not.

Anyone who may be able to help my case by showing their poor conduct contact me by placing a rebuttal here. Thank you,

Take that car and drive it through thier front door and park it on the jerks desk who is threatening you. [That's how I would handle it].

But if you don't like that idea, get a digital phone recorder that has a large capacity, and download all of the conversations to your computer. EVIDENCE!!

You need to lower yourself to thier level to beat them. Unfortunately.

Still More abuse after payment was made 4 days early!!

Okay, so here's more to add to my story!
In January, my pay date fell 2 days early. As is the norm, I went to the bank to cash my check. From there I went to the local Western Union center to make the payment on this loan. This was a Friday, actually Friday the 13th of January.

The following Monday, the office was closed due to Martin Luther King Jr. day. Tuesday, around 1:00 pm, my wife received a phone call from them. When she told them I wasn't home, and asked VERY NICELY if she could take a message the lady on the other end of the phone said " Well are you permitted to talk about this account?" My wife said that she was. The lady then DEMANDED to know where the payment was on this account. My wife kindly said, " Have you bothered to check your Western Union payments from Friday? Because the payment was made on Friday, before 5:00 pm." The lady got very snippy then and said to my wife, " I need the control number then off of the Western Union receipt." My wife very nicely gave it to her, and she then said to my wife, " The next time the payment is made you are required by LAW to call us and give us the information off of the Western Union receipt. " My wife said to her that we were never told this before and asked why all of a sudden that this has become the "rules" .. and also told her that before they call, they should make it a "rule" to check their Western Union payments for the prior days." She told my wife it's not their practice to do this. Anyone have any similar stories??

Okay so how about this one? As promised, I Western Unioned my payment to these people on the 31st of August before close of business at 5 pm. I left my job, and went and did this so they would have their payment that day, as I had promised.
The morning of September 1,2005 at approximately 8:45 am, a man showed up at my house. He had a letter for me from United Auto Credit. He told me that he was advised by them to deliver the letter to my husband in person, where was he at? I replied, he's at work, and I'm calling my attorney first then I'm calling him(husband).. You people aren't allowed to harrass us, ESPECIALLY since they got their payment yesterday before the close of day as they were promised. This man also told me that he was to take pictures of the vehicle for them and get them to them asap. He had no idea why or so he said, he worked for a company called Guardian Portfolio out of Sarasota, Florida.
He was very apologetic, and never bothered to even ask where the car was to take the pictures, and get this, couldn't believe how this company has threatened myself, my husband and our two children!!! When I told him that they were sending an agent out to get my husband and that my husband better hide in the closet he "flipped!" He couldn't believe that these people acted the way they do, and that he was going to talk to his superiors about handling any more business with these people.
I have the letter here, which was dated for the day that the payment was to be made. My husband called them twice on the 31st of August to reassure them that the payment was still going to be made that day, and the first person he talked to hung up on him, then the second person he called, all he got there was voicemail. Finally another man called me at 9:30 am that morning and asked what the problem was this time, and I told him that all my husband wanted was to tell them that the payment would still be made that day before the end of day, and he got smart with me (one more time) and said well you dont have to take that tone with me, and with that hung up.
