Boggles the mind! How on earth are companies able to get away with this???

First off, I have never applied for a loan with this company, never ever ever.
Second, NONE of my current mortgages have been sold or transferred to this company! (yes! I checked and double-checked!) And yes, current means current--my mortgages with my REAL mortgage lenders are current.

Yet, somehow, someway, this company is insisting that I am in default and must pay up. They have even engaged a local attorney to further pursue their "loan".

I've sent certified letters [cease and desist; proof of claim; etc.] but apparently no one reads them, because I certainly have never received and written verifiable proof of debt.

So, dear Ms. Natalie Jones at extension 3830, please send me written verifiable proof of your claim, otherwise, press the delete key on your bogus claim.

Just by accident I discovered this report while investigating UM Aquisitions/Rescomm Holdings no2. My interest was their being mortgage holders on a foreclosed property I'm interested in buying. After reading this I will procede very cautiously so as to not end up in a title/paperwork quagmire. Thank you for leaving this information on the "odd chance" it might benefit others, it has!

Yesterday received a notice from the US Bankruptcy Court regarding the Chapter 7 bankruptcy filing of Homevest Capital LLC, indicating that I might be a creditor with certain rights against this company.

My first reaction was huh?? Do I even know who this company is?

A day spent Googling has furnished me with a few results, bringing me here to update my original complaint.

Homevest Capital LLC filed for Chapter 7 in February 2009. After finally locating an online copy of the petition, I see that they have also listed "UM Captial LLC" as a subsidiary, affiliate, etc. The name on the Chapter 7 petition is Scott Hoehn.

More Googling found that UM Capital LLC also lists Scott Hoehn as a principal. More Googling on Scott Hoehn and UM uncovers multiple grantor/grantee relationships between UM Acquisitions LLC and UM Capital LLC (foreclosures and foreclosure processing). The same Scott Hoehn also appears....

UM is also short for "United Mortgage". Scott Hoehn is also listed there....

I do not have access to all of the resources which may release the complete picture of this tangled corporate web... and most likely my name appeared as a potential creditor against the Homevest LLC entity as a result of my complaints against United Mortgage almost 2 years ago.

Just an update -- hopefully this may be of some use to someone, somewhere...

Hi all, and thanks for the tips!

I haven't refinanced, ever. I have my most recent mortgage statements from my current lender/servicer and their online version agree to my printed statements--and no change in servicing on the notes.

I've tried to get written verifiable proof of the note they claim against me, but they haven't sent me anything, other than increasingly hostile demand letters. I've sent a request for verifiable proof to the attorney they engaged locally [J. Michael Lovejoy] but haven't heard anything from his office either. However, I only sent the letter to his office within the last 72 hours, so perhaps more time is needed from their attorney's office.

It didn't occur to me until I read the comment about possible identity theft--which seems to me right now the most likely event? How on earth would one clear up identity fraud on a mortgage???

This would be truly weird to have a foreclosure [if it comes to that--so far there have been no threats about foreclosure--that is part of the reason why I'm thinking it's some sort of scam or fraud] on a property I know nothing about.

Also, googling the company name turns up....nothing? Another reason why I think this is some sort of scam or fraud.

Did you happen to ask them for the address of the home the loan is taken out against? Did you re-finance in the last couple of years?

What if you refinanced while your old loan company was about to sell your loan to another company. Then your original company got your payoff, but did not pull your mortgage out of the sale to the other company?

I know you said you never did business with these people, but your old loan could have been sold to them. Did you receive satisfaction of mortgage papers from any previous loans you had? If public records are online in your state (they are here), you can search your name to see all your outstanding mortgages. You can also see all your satisfactions of mortgage too. Make sure there is a satisfaction filed for every loan you took, unless it is your current one.

If you are absolutely positive this is a mortgage loan, and you are absolutely positive you do not owe these people, I would contact your present mortgage company and have them help you investigate.

Like you said have them show you the loan paper work before you do anything. They should have obtained picture ID as well as other info prior to doing the loan
