I have been going to court for over a year now with UPS attempting to get them to pay an insurance claim for damaged goods. They are self insured and do not come under the jurisdiction of The Insurance Commissioner however they should come under The Carmack Amendment Title 49 United States Code section 14706(d) Civil actions.

They rely on the consumers ignorance of the law to deny any claims filed against them. I believe they are making a great deal of money by charging extra for insurance and then not paying on a legitimate claim. This mess has already exceeded the max. amount you can go for in small claims and I still have not got anything. We are scheduled for court again on Sept. 9, 2002.

I have 13 pages of complaints against UPS downloaded from the Internet that only cover this year. Every one of them is for the same thing. Non payment of damaged merchandise. Some of these complaints were from people that had obviously damaged packages when they were delivered and the drivers didn't inform them of the insurance provisions. Even though they kept the original packing material UPS would not pay the claim. They said they were not properly packed. They do not make the provisions of their insurance available until after a claim has been filed. There is nothing posted in the UPS office, nothing on the package or shipping invoice and until recently nothing posted on their web sight.

I think they should be forced to make the consumer aware of the provisions like every other insurance company is required to do.
