HI,
Upstate Exotics advertised a snake that was 100% het for yellow Ghost on their web site. This company is owned by Sal & Alison Tornambene.
I asked them before I committed to the purchase if this in fact was a 100% het for Yellow Ghost. Alison from upstate Exotics then replied yes on 03/28/03. I then emailed her after she confirmed it was 100% het with papers and allow the payments to be extracted from my Visa debit account on 03/28/03. On 03/28/03 Upstate Exotics took out $100.00 dollars as a down payment.

I emailed her on 04/01/03 to make a $80.00 payment. Upstate Exotics took out the $80.00 dollars on 04/01/03. On 04/06/03 I emailed upstate Exotics to make a $50.00 payment. I then received this email.

I was going through my paperwork this morning. I cannot find the paperwork for this het ghost. I found all the other het papers except this one. I'm not sure if I had sent it out by mistake, but I know for sure this is het for yellow ghost from Corey Estill. Please let me know if you are still interested. I can take off $50 for the mix up if you're still interested, if not I can refund you the money.

I emailed the on 04/06/03 to give them a little to time to try to locate the paper work on this snake. I emailed Upstate Exotics on 04/08/03 and left phone message, no response from them. On 04/09/03 I finally got Sal By phone he said he would have Alison call me back, she never did. On 04/09/03 I emailed Upstate Exotics, no response received. I emailed Upstate exotics on 04/12/03, no responses received. On 04/18/03 I finally got Sal on the phone he stated he would call me back after 5:00 PM, he never did.

I emailed on 04/19/03 I explained to upstate exotics due to there avoidance on this issue I am electing my rightful refund. I emailed from 04/08/03 through 04/19/03 with no response. I left several phone messages that were never returned. I emailed them on 04/20/03, no response. I emailed them on 04/21/03, no response. I emailed them on 04/22/03, no response. I finally got Sal on the phone, he stated that I was right. Without proper paper work this snake was not what it was advertised as. He then stated I would receive an immediate refund.

I emailed them on 04/24/03, no response. I emailed them on 04/25/03, no response. I emailed them on 04/26/03 no response. I emailed them on 04/28/03, no response. I also sent them a fax on 04/28/03 at 1-866-738-7499, no response. I emailed them on 04/29/03, no response. On 04/30/03 I contacted visa to dispute this fraudulent charge on my account. I posted on a public forum about his incident.

I received a letter dated 05/30/03 from the Better Business bureau that Upstate Exotics will not respond to my complaint. Thank for your time.

I'm not sure if you used a checking account or credit/debit card but contact your bank or credit card company and do what is necessary to have the money returned to you. The email this woman sent, along with all of yours, is evidence that they offered a refund and you eventually accepted it. You can supply your financial institution with this evidence in case they attempt to dispute it.
