My husband and I also contacted US Metal Buildings for a price quote on a large building to be used as housing/garage.  Same story as everyone else reports, they tell you one story on the phone but the papers they end up sending you do not reflect that same info.  We are out $11,000.00 with no building, went to an attorney who told us that we have no legal option because of the way the Terms & Conditions are written up.  He said we should contact an attorney in Deerfield but we decided that would probably do no good since the Rack family seems to know how to professionly & legally rip people off.  We assumed their might be an attorney within the family involved...so that didn't surprise us.  If you have been ripped off by US Metal Buildings or one of their other companies contact the Office of the Attorney General, Consumer Protection Division in West Palm Beach FL.  Reference Case #L13-3-1134, they are currently looking into it and contacted me in October of this year.

Why we lost our $11,000 deposit

We lost our deposit because we signed an agreement to purchase.  After receiving the document which we thought was only to sign for the deposit, we noticed that it was an actual a contract agreement to purchase the building.  When we read through the agreement there was not much information on the buildings specifics but there was a discrepency on the ceiling height it was incorrect so we immediately called our sales rep, Eric Waggoner, who again told us that all we were signing for today was to release the money to them for the deposit to hold the building from going to auction and that all the details would be worked out as soon as they secured the deposit to hold the building.

The contract states that the deposit is non-refundable which we didn't see as a problem at first because we discussed in detail with them what we wanted and they were bending over backwards to make that happen.

We say they breeched the contract after numerous lies and they say we breeched the contract because we failed to sign the release for the building to go to manufacturing (the building that was supposedly already constructed and being shipped to auction) and paying the next $11,000 installment.
