Almost 2 months ago my car was hit head on and totaled instantly by an escalade going 50 through a red light in broad day with a car full of lacrosse playing pre-teens who "needed to get to their game". This awful woman crawls out of her barely damaged escalade and grabs her designer purse and gets on her blackberry and starts dialing. I am walking down my staircase to get to my car that i parked LEGALLY across the street of my residence and I hear what sounds like an atom bomb and go out the house and look across the street, and there is a 4 car pile up in front of my house by the intersection on the corner of my street. This piece of rubble under a huge gold SUV is my car....the only car my family has....

I immediately start to go toward the car and sirens flare and police surrounded me, the screaming hysterical crying girl in the street and try to calm me down. I am from a lower middle class town and this car was my way of living. I got to work by it, and since I am not legally allowed to rent a car because I am 18, I was REALLY screwed. I had to have my uncle drive me to work, pay for gas and risk my neck being late everyday because God Bless him, he is elderly and drives like a snail. 2 months, no car, no check, nothing. I contacted one of their claims adjustors and I paid for them to next day air carry my check to me so I could jump on a sweet deal on a car and obviously its not here. I did this 4 days ago.

Someone needs to bring this company down, I am the revolutionary beliver in my rights, few as they are. Contact me if you have been wronged by this faux insurance company. Collectively we can bring down this rabid animal company.

Was your car insured? No good reason for it to be uninsured. Did you notify your insurance company? They could be on the hook if the at-fault driver does not pay, thus your company will want to get payment from the other driver.
If not insured, you can file a law suit. You say the police were there, so you must have support that the other driver was at fault. You don't say what the value of your car was, but it may be low enough to qualify for a small claims court action. Your case is against the car owner and/or driver, not the insurance company.
Several years ago I was in a similar situation. Once I filed a suit, then that driver's insurance company was eager to talk with me and work something out.
But I suggest talking with your insurance company first; you are paying them to help you.

You should have filed a claim with your own insurance. Many insurance companies will waive the deductible if it is obviously not your fault.

Just like many insurance companies take time to settle a claim. By your own report, there was a 4 car pileup from this accident. Well, under most states' own minimum liability insurance, there may not have been enough insurance to go around to all the parties! In which case you probably would have to sue the driver to be able to get anything. That's why you carry your own insurance so they would get the money for you. That's what it's there for.

By the way I have USAA.
