my wife and ihave filed a lawsuit against our insurance company usaa for underinsurance. my wife received a spinal injury, brain injury and as a result is in constant pain. she also start to suffer seisures, memory loss, emotional problem and was unable to return to work and in fact was placed on total disability due to this accident. the responsible party's insurance company paid for damages, they paid within six months and without conflict. ssd also begin in six months with is unheard of as response from specialist treating my wife.the responsible insurance company paid a total coverage of 25,000.00.

finally when making the claim for our underinsurance coverage is were the turmole started, first they claimed she had not filed the claim correctly. second the were deny the claims they stated she had filed" the medical provider submitted. third they started to make comments that this accident had not caused these injuries, she was faking and just didn't want to work!

when we started our lawsuit against them a year after they made claim which was put in trust for pay back of the claims they all of a sudden paid, remeber they said they never receive the claims in the first place. tricare had to declare her medical treatment as a disaster and paid those unpaid claims first so that the medical providers could receive payment. usaa began to request ten years of medical information from my wife, high school and college transcripts from twenty years ago! friends and co-workers letters as to her charater.

while she was trying to deal with our finaces alone she was told not to drive a vehicle so she contacted usaa to request a storage rate as to she was no longer able to drive, the claim agent told her that she would have to turn in her drivers license in order to do this and to call back when she had. upon calling back and our son receiving his drivers license she did this, the agent stated that she could not receive the storage fee rate after talking to the underwriter. however she also stated that because we had only one person my son on the policy that it would be sky high so we will just leave it like it is.

i was serving in irac and was brought home to care for my wife as medical providers informed the red cross as well as the military. it has be three year and prior to my coming home my wife was harrased by agents of usaa. i have since retired and my wife's health continues to decline she is in constant pain and requires constant assistance in everyday life, all the while she keeps thinking she will recover and life will be as it was, that she will go back to work. she will never be able to return to that life! we have worked with social workers and the such and she is still not accepting of her condition. i believe i have covered everything here and in addition my emotions are begining to over come me. i needed to share our story.
