Well this bank claims they are a second chance bank. At first i thought they where honest. The first time i suposely overdrafted my checking account i called them and explain i had made a cash deposit in the bank so they told me i had to make sure i told the teller it was cash and i needed to post the same day.. i found that strange, that i would have to tell this to the teller.SO they waived 3 off the overdrafts and still charged for one which was $34.00. AT this time well i felt it better than pay $136.00.. what finaly pissed me off is when they tried the same s**t! on april 11 2006..but this time they claimed i had bounce 5 overdrafts and they would settle for $85.00..The way this bank works if you deposit $900 in atm they claim it takes 5 bussines day to clear..the other thing this was deposit in thier atm at the bank..you so people understand i had over 1400.00 dollars in bank..and these fees where for Visa transaction ranging from $3.85 up to $39.00.. here is my acutactal on line statement Transactions you be the judge!!

atm deposit

when usbank gets an atm that can tell the difference from cash or check you will always have this problem. we will never get a product like that cause we will be out of business if we did. the atm cant tell if you deposit cash or check so that best thing to do with cash is to go into the bank. cash goes in immediately. you shouldn't have to tell the teller it's a given. But be aware that we can still hold cash for any reason and that is a state law that gives us the right to do so. so just be patient dont spend the money before you make your depoist and keep a register. You can't go wrong if you do all of that. Many try to beat the system and sometimes you may luck up and win but it's a hard system to beat so don't try it.

The lawsuit...

was not about posting largest to smallest. It was about not notifying customers of that change. It is legal for the bank to post in any order they want, they just have to let account owners know the policy. If they change the policy they have to let customers know. However, if you don't overspend your account it doesn't matter how the banks post.

US Bank does that as well, it is not an unusual practice. The point is, you need to have money in your account for ALL your purchases. It shouldnt matter in what order they clear.

Time for a class action suit

This has gone too far with the banks. A report from a congressman out of Florida says that these prctices have added 37 billiion dollars into the banking industry. It is time we stand up to these theives.

Excessive overdraft fees
In 1999, a class action lawsuit was filed against Bank of America for engaging in the

practice of "Biggest Check First" check clearing. Put simply, the bank clears checks in

order from biggest to smallest, with less regard to when they come in. Customers allege that

this is purposely done, to cause more checks to bounce, triggering more overdraft fees for

the bank to collect.

BOA paid a $9M settlement to end the lawsuit in 1999, but they continue to process

transactions from highest to lowest amounts. New York, California, and Nevada are currently

fighting the practice.

It's not a good idea to deposit cash into an ATM.

If you had the cash on you, why not hang onto it until you can get into the bank and deposit it with a teller?

If it was to cover what you had already purchased than that is your own fault. You should never spend more than you have in the account at the time you make the purchase.

If you want to "float" money. Get a credit card and do what my mother does. Pay it off completely every month. It's alot better than getting fees because you couldn't get the money into your account on time. The key is not to go crazy with it. (Maybe a prepaid card?? That way you would be able to have a little extra when your bank account goes down you won't have to worry about deposits and NSF fees.)

Time and method of deposit

#9Consumer Comment

Thu, April 13, 2006

Deposits at ATM's, cash or otherwise, are subject to hold for verification. Some banks do not service ATM's on a daily basis, rather once or twice per week. This results in the availability of any deposits being delayed until the ATM is serviced and an actual reconciliation between the amount of deposit entered on the keypad and the cash/checks in the ATM.

With an account history of NSF's, even though the bank waived fees and the NSF was their fault (according to your statement) the account would automatically flag to hold any ATM deposits for verification. Conversely, if you had a long term account with no flags, and possibly also savings or multiple deposit accounts with the bank your deposits are likely made immediately available to you.

If you made a cash deposit at a teller you should not have to notify the teller, this should be indicated on your deposit receipt. The time of the deposit is critical as banks work on "business day" schedules. A bank will usually post a notice that "All deposits made after X:XX p.m. are posted the next business day".

If you make a deposit say on Friday, at 4:00 p.m. and the cut off time is 3:00 p.m. according to the bank your money is not deposited until Monday. If you write subsequent checks and these reach the bank on Monday as well you will likely see NSF's. This occurs because the bank processes all transactions that DEBIT (remove money) from your account prior to processing deposits. So if your balance on Friday is $50.00, You deposit $800.00 Friday at 5 pm, Write a $100.00 check at 5:30 pm and both reach the bank on Monday the transaction record will show:

Balance $ 50.00
Check #123 -$ 100.00 RETURNED
NSF Fee $ 35.00
Balance $ 15.00
Deposit $ 800.00
Balance $ 815.00

If you wrote multiple checks and they arrive on Monday, you could EASILY eat up your entire deposit before the money is credited to your account. This is in the bank's interest as nationwide banks make BILLIONS a year in fee income alone.
