USIS usis.com reported a false background check to a job I applied for. They turned 3 misdemeanors into 24 counts deliberatley and a 90 year sentence. None of this was true. Lincoln Nebraska

I recently applied for a job at Swift Transportation and was denied of this position due to a falty background check ran by USIS. The background check THEY ran consitsted of numbers of lies. A meaningless count of 3 misdemeanors and a 93 day sentence under MCL 750.81 punishable by 93 days was turned into a 24 count and 90 year sentence/54 year probation.

This turned SWIFT from my application and lost me necessary money and a job. I would like it very much if anyone could contact me with helpful information about USIS or any lawyer that would be interested in helping me pursue this case. USIS deliberatley threw off my background check to cut corners and save themselves the hassel of paperwork. These malicious actions that the company made need to be noticed and taken care of as soon as possible.

""and a 93 day sentence""

Have you considered that perhaps your "meaningless" misdemeanors and subsequent 93 day sentence was perhaps enough for them to reframe from hiring you?

Most employers, as I, do NOT CONSIDER A JAIL SENTENCE to be minor. When considering candidates there is a process to create a "short list" of folks who will be granted interviews. I have an application form that must be honestly completed, including any convictions and this form also authorizes me to run credit checks. Any criminal history or "bad credit" means I toss the application into the "no hire" folder (I do NOT toss them out). This is my FIRST cull and it's quick and fast. The second cull is when I actually READ the resumes and the final cull is done shortly after the interview.

At any time during this culling process, if it is discovered that any information given in writing is FALSE, the applicant is no longer a viable candidate and all paperwork goes to the "no hire" files.

As to the false information that USIS presented: have you challenged this information in writing? Have you requested the sources of this false information?
Is it possible that someone with your name or a similar name was assumed to be you?

I would make a written request for the sources of this bogus information. There is a possibility that some where there exists a public record or database that has this information under your identifying information. You probably should check into this and take action to get the source of the information corrected.

What I'm suggesting to you is two things:

1. that you formally request confirmation of the information in their report and the SOURCES of the information so that you may take action to have the sources corrected. This is very important in that it may effect other aspects of your life later on.

2. That your correct information about the misdemeanors and 93 day sentence was probably enough for them to not offer you the job. The bogus information certainly shot your chances, but what I'm suggesting to you is that even if they gave the correct information, you very likely wouldn't have been hired-especially if they have other candidates who DO NOT have conviction records.

Good luck.
