In July of 2008 my husband and I purchased a 2007 Mazda CX-7 from Utah Auto Sales. We traded in our 2002 Nissan Altima and they were supposed to pay us $6300 towards our payoff on our loan and then we rolled the remainder of the money into our new car loan. A couple of weeks later they sent us a letter stating that they are currently "restructuring" and that they would continue making payments until they could pay off our loan in full. They have NOT made ANY payments, nor have they paid the loan off. They have our Altima and sold it at auction, yet my loan is NOT paid off. Now the credit union where my loan currently is is saying that I need to make two months worth of payments otherwise it will hit my credit. My dad is the co-signer on my vehicle and is not able to refinance his house because of the delinquent loan. They do not return emails or phone calls and have a bunch of lame excuses each time I have gone in. I until November 20th to make at least two car payments on my car that I don't even have, PLUS I still have to make a payment on my new loan! Sounds like fraud to me!

Thanks for the novel, but that doesn't keep me from getting phone calls from my credit union threatening to sue me.  Nor does it get me my title for my car or fix my credit.  I am out A LOT of money.  And don't try to tell me about his character.  I've been working with a lawyer who gave me a nine page long lawsuit against Kevin Gallagher.  It's a huge lawsuit that doesn't involve vicitims like me.  It's a lot bigger than that and it PROVES that Kevin was doing stuff he wasn't supposed to be doing and he SCREWED a lot of people.

   I have known Kevin Gallagher almost my entire life and I have bought over 15 vehicles from Kevin over the years.   I can see why someone would be frustrated by the situation at hand but I would like to provide some personal input regarding Kevin Gallagher's character.   I would simply like to say to anyone providing negative comments about Kevin to really think about the facts of his situation.   Kevin has spent his entire career building relationships and doing the right thing for the masses of people he has come into contact with and knowing Kevin personally I can easily say that he IS a man of integrity, I have spoken with my bank on a number of occasions and they have let me know the status of the deal Kevin has been trying to make with them and the terms they are asking for are beyond reason, he has been in contact with me every step of the way and yes my credit has been damaged but I do not blame Kevin because I have seen him at work, he as gone to bat with every financial institution in Utah county trying his best to fix the loans that are in default and some of these banks and credit unions simply do not care to work anything out.   I know of a gentleman that has been a member of one of these credit unions for 30 plus years and this institution simply will not work with Kevin or the client and I heard this first hand from the gentleman mentioned above.   Kevin Gallagher is one of the most selfless, kind hearted people I have ever met IN MY LIFE and it is sad to see people coming after him who simply do not know the type of person he is.   I know first hand that it is frustrating to have banks and credit unions dinging credit every 30 days but some of these places only care about the shareholders profits and not about the consumer, i think it is funny that these places write off hundreds of thousands in bad home loans everyday but they cant realize that most of them have made a FORTUNE off of Utah Auto Sales over the past 12 years so what is so hard about having him sign a contract to pay back some of the money and releasing some of these innocent consumers from these vehicle loans???   So before attacking Kevin please take into consideration the fact that he is only human and he is only one person trying to make right some of the mistakes made while trying to run a very complicated business, yes he will sometimes take several days to get back to someone but he has been trying for the past 2 years to make this thing right and that is i think pretty amazing considering almost every dealer who folds and goes under simply walks away, moves to another city or state and just pretends like it never happened and that is not the case with Kevin he has faced the music and I find that to be a rare characteristic found in business today.

A couple of weeks after trying to find a solution to the problem we were having, my husband and I found out how to get a hold of Kevin and were finally able to talk to him face-to-face. Up until then we had been sending emails to a person who was no longer employed there, apparently. Kevin had no idea what was happening with our loan and he has since made a bunch of our car payments and is still working on getting a loan that will pay off ours, and other's car loans. He returns all of our phone calls and emails and it's been really nice working with him. The car loan is still not paid off, but Kevin is working his butt off to get to the bottom of it all. He could have run off and left everyone high and dry with all of these loans, but he's doing everything he can to get everything taken care of.

And if you did, you could file a civil suit for the amount of the money they owe you and other damages.

You can also talk with the District Attorney's office and file for THEFT BY CONVERSION or just plain THEFT.

AS YOU CAN TELL, I DO NOT KNOW THE LAWS IN YOUR STATE AND I AM NOT QUALIFIED TO GIVE LEGAL ADVICE CONCERNING CIVIL AND CRIMINAL MATTERS IN YOUR STATE.
