VAN RU Collection Agency STOP These ACTS OF VAN RU Chicago Illinois
I recently called the Dept Of Education, they gave me a third party collection agency contact#. I spoke to one company and they were very professional and I had worked out some terms with them, but due to the nature of my job status I did not no if I could fulfill that amount of obligation. Within one week the account had been forwarded to Van Ru. They called me the same day the account was transfered. The Collector Was rude and out of control. I had to let him know that I had worked as an accounting & collections manager for many years and I understood my rights. I had to break down to him the section code of the FDCPA laws. Which he was not abreast on. I spoke to his supervisor and she did not care how he had acted in our conversation. The same collector had called back several days later and was rude and out of control and basically started saying things that he should have been saying about my personal things while collecting a debt. THe terms he was offering he stated he would not put them in writing which he must do! Basically, All THAT has dealt with van ru must get knowledgeable about your laws and rights. If any collection agency starts acting this way you need to send a cease and decist letter immediatley! State the facts why you want them to stop contacting you but you have every intention in paying your debt and send it directly to the original creditor. This will force them to do something about these type of practices.

The FDCPA applies to ALL third party debt collectors, even if collecting school loans.

Although it is true that school loans cannot be written off, any third party collector must comply with the FDCPA which includes honoring validation requests and cease communications requests.

Was this a student loan?? If is was then that is a whole different matter
I despise third party collection agencies but student loans are very different
They cannot be charged off - asked an attorney friend of mine and he confirmed this -
If this was not a student loan then hit them where it counts - in the pocketbook
