Vandyke Mortgage Corporation, Dan Chandler Misrepresentation and outright lie's during a refinance, misqoute's etc. just to close the deal. ripoff Grand Rapids Michigan
During a recent refinance through Vandyke mortgage, while working with one Daniel chandler, I expected a simple refinance of a $106,000 first mortgage, and the paying off of just two credit card balances together of about 7 to 8 thousand dollars. This was the only deal discussed, my purpose being to lower my mortgage payment and get rid of the cards.
When it was all said and done, The credid cards were NOT paid off, My Mortgage was in fact $8000.00 more than before and the payment was $70.00 more dollars a month!
I tried for over a week to contact Dan Chandler but he would not return my calls, When I did finally get him on the phone and explain the situation, he stated he would find out what was going on and call me back, Three days of waiting for a call that didn't come I once again tried to reach Dan, for two weeks I tried, leaving numerous phone messages, I finally called an associate and left a message with him, Dan Chandler called within the hour!
At that time I was informed by mr Chandler that the payoff of credit cards weren't a part of the deal, The argument went on for some time with mr Chandler insisting I knew that, which is false. This whole deal was full of misrepresentation on mr Chandlers part. The funding was done through Countrywide, and I've written them a letter of complaint as well. "Beware of Vandyke Mortgage Corporation and one Dan Chandler!

Borrower must read documents before they sign!!

As a loan officer for over 4 years, I can only tell you that the loan officer is required to give you a Good Faith Estimate. This lists ALL settlement fees and the application you signed also shows all information, which would have included your credit cards being paid off. Any of there fees that are disclosed can not increase without being redisclosed. The interest rate is also disclosed on the final application at closing that you signed called the "Truth and Lending" document.
At the closing, the attorney is required to go over all information and asks you if you understand or have any questions. The interest rate is ALWAYS mentioned. If nothing was mentioned about your credit cards being paid off, why didn't you ask. All that information would have been disclosed on your final HUD.
Part of the reason our industry is in the current chaos, is because borrowers like you did NOT take responsibility for understanding documents before you sign them. I was taught as a child to NEVER sign anything unless i fully understand what it is i'm signing.
Please do NOT blame either this mortgage company or loan officer. It's possible the loan officer did not include the credit card debt but as a borrower, you should have noticed these liabilities were NOT included on either the final application you signed at closing or on the final HUD as well as your new total payment and interest rate. All of this would have been mentioned by the closing attorney. You are NOT required to go through with any deal, even if you are sitting at the closing.

Response to Vandykes rebuttal!!
If a three minute conversation with me over the phone constitutes an investigation, then Vandyke did a good job. Otherwise, this is just more lip service from a company attempting to cover their a*s! Vandykes investigation, as well as keeping their agreement with me is BS! "Dan Chandler is a liar"!
If I had the resourses to hire a lawyer and take them to court, I would have, but when your dealing with Liars and cheats theres no guarentee of success! I'm like most americans living paycheck to paycheck, I can't afford the expence if I lose! They know that, and prey on people like me!
Vandyke Mortgage owes me $8000.00 dollars, thats the amount Dan Chandler ripped me off for, until its paid, I will continue to bring their unprofessional, and unfair practices to light to as many people as I can!! you got away with it this time, my hope is that this report will prevent anyone else from being cheated by you!
I STRONGLY RE-ASSURT,
"BEWARE OF VANDYKE MORTGAGE" and one Dan Chandler!
Their after nothing more than to fill their pockets with your money, having no concern for you or your welfare!
No wonder the Mortgage industry is in the shape its in! With companies like Vandyke, its not going to get any better! They and companies like them are why thousands of people are facing forclosure!!

Upon being promply contacted by a senior vice president of Vandyke Mortgage corporation, after learning of what had happenned, I feel confident that the problem I've experienced in this refinance is NOT with Vandyke Mortgage, but rather, with a certain individual! Measures are being taken to correct this! I will file an additional update once this is concluded!
