I do believe Memberworks is a legitimate company in itself. However, it could be that because 13 million members are enrolled in one of its variety of programs, chances are that 0.1 % of the telemarketers may have not all been trained to follow legal procedures correctly, especially new employees. So that's still 130, 000 potential complaints.

Legal procedures include asking for authorization for billing, and letting the members provide them with their credit card numbers themselves. Possibliy some small fraction of the members have do not ask for authorization even if it is against Quality Monitoring evaluations.

Vertrue has established new rules with respect to adminsistrative procedures: compliancy "Did not authorize" verbal quotes as compliancies for MN/MI/FL/NE/NY states. Whenever a member calling to cancel says "she did not authorize", the word "authorize" and not any other word like "consent" or "OK" triggers the compliancy procedures.
