I was recently sent to a Viking Collection Agency by Capital One even though I was making monthy payments on an account I requested to be canceled. Is this even legal and allowed in this country?! Since being turned over to Viking, I have been harrassed night and day by an employee named April, withwhom I have noticed her name mentioned in other postings on this site. It's bad enough being harrassed at home but when these outrageous people start harrassing us at work, is there ANY form of legal action we as the working public can take??? If so, PLEASE TELL ME! Any assistance on this is greatly appreciated.

Write a letter, send Certified Mail, Return Receipt to these people. Be sure to tell them that you are exercising your rights under the Fair Debt Collection Act and they are not to contact you via telephone (both at home and place of employment), via fax, US Mail, or through third parties. Tell them that you do NOT deal with collection agencies or debt buyers and you will work ONLY with the original creditor. Be sure to cc Capital One and your state's Attorney General. You can also fax this letter to them, but be sure to keep the return receipt.

You should definitely mention that you are disputing the debt and any attempts on their part to report it to the credit bureaus as anything other than disputed will be met with every legal option available to you.

Paying debt buyers/collection agencies will NOT clear your credit..once they have your money, you are fair game and your information will be sold time and time again.
