Complaint Review: VIP Homes - VIP Construction

VIP Homes - VIP Construction ripoff signs deal to sell or build house with agreed to stipulations, then changes deal and raises price, and force buyer to accept un-needed appliances. Mesa Arizona

On 9-29-04 a deal was signed to purchase a spec home that was in framing stages that was due for completion by the end of December 2004.

The purchase price was greatly inflated by $20,000 in less than one month from when we first looked at this model, till the time we made our decision.

We are also charged a $5,000 fee because we choose not to use their preferred lender, however this fee was added on after our documentation was signed and we were asked "do you have a lender".

On 9-30-04 our lender provided the $3000.00 earnest money per the arrangments.

On 10-19-04 a change order was made and signed by VIP and the buyers for Tile Upgrades, Corian Counters, Carpet Modifications, Credit for using our own supplied appliances of $816.50, allow us to use our own new supplied sink and faucet, and changing the landscape package from B to A. While we there we had the sink with us, and their rep measured the sink and confirmed that it would fit without issues. We also choose colors of the counter top that accented the color of the sink, so as of this date everything is a go.

On 11-01-04, we receive call from the rep, stating there is a problem with our appliances and sink. It was stated that we have some major problems with the appliances provided, and we asked what problems, they answered the plumber refuses to put our supplied sink and faucet in and the Vice President of VIP nixed the deal and that we would have to use the "standard package" and lose our credit of $816.50.

This presents several issues, we now have appliances that our totally useless to us, and a sink that does not match the decor that we chose around the kitchen area.

We attempted to work this out with them on the phone, however they was no compromising, and VIP homes "drew the line".

We feel that the plumber "cryed" to the VIP management about having to deal with "other" appliances, and VIP management caved.

We also asked about doing some of our own "simple low voltage" home theater wiring prior to drywall, because they do not offer a wiring package on this home, we were told that we would get a callback if there would be any issues with this work. We never received a call back.

This sort of activity makes us wonder just how other matters in the future are going to handled, and when they to get back with us, "its their way or the hi-way"

Newly Discovered Documentation Surfaces that Clarfies the Current Dispute.

Because of certain documentation that had been withheld by our realtor, we retract these following statements on the original report, and any updates we have made to the report.

It is unknown as to why the documentation was withheld.

We continue to work with VIP to bring this to resolution.

Apparently there is some confusion as to this statement, that we wish to clarify. Originally when the home was looked at the price was in the $230,000's. However when we made our decision the prices had gone up. This we had no issue with as we signed contract with the "new" price, however felt that this price increase needed to be mentioned simply to show that we were doing our due diligence and not buying the "first" property we set our eyes on.

Clarification of Portions of Dispute

In an effort to bring this dispute to closure we are updating the report with the following information:

This statement is true however VIP continues to persist that we purchased the appliances and the sink AFTER the purchase contract was signed. We have available receipts showing that the appliances and sink were purchased PRIOR to the purchase contract being signed.

We made several attempts to contact the supervisor through the sales agent, however none of our attempts to solicit a call back regarding this question were answered.

We continue to try and work this dispute out in a professional manner with VIP as time goes on.

VIP Homes Alleges Privacy Violation

On November 4, 2004 a letter was written by a VIP Homes, Vice President. This letter is in direct reply to the Rip Off Report that was filed on November 1, 2004.

In this letter they allege that we have violated privacy acts by posting the President of VIP's home address on the Rip Off Report.

This information was received from public records at the Arizona Corporation Commission Web Site of which is freely searchable by any and all visitors.

Also stated in this letter is that if we do not re-finalize the deal by 5pm - 11/10/2004, the contract shall become null and void and the seller will return the earnest money.

This letter was signed by the companies Vice President and CCed to the CEO.

At this time, we have let the deadline pass, and have requested they comply with this offer letter.
