The company that is ripping me off is Vision Investing Group LLC, Learn2SpreadTrade.com and Independent Marke01 of 01. They are located in American Fork, Draper and Provo, Utah.

I bought the Learn 2 Spread Trade infomercial course on 2/2/04. On 2/12/04 I started getting phone calls by sales reps about the online seminar course on stock option spread trading. I was interested and asked for a reference who had taken the online course.

Initially the sales rep, Terry Austin, told me that I would have to pay a deposit of $100 to have access to the reference. He ended up giving me their reference's name and telephone number without charging me a fee. On 2/22/04 I had my first of several phone conversations with their reference, Mr. Scott Jenson. Mr. Jenson suggested the class and insisted that I only sign-up if I got the trainer named Brent. Mr. Jenson said that Brent was the only trainer that he would recommend. He told me that he had been told that the other trainers did not do the type of stock option trading that they were teaching.

On 3/10/04 I told the rep, Terry Austin, the only way I would take the classes was if I got Brent as the trainer. He said No problem and told me the training would start around April 1, after a 2-3 week waiting period.

Starting on 3/18/04 I called to confirm the training. I was told Brent wasn't doing training then. I then left several messages for the sales rep and he finally returned my call 12 days later on 3/30/04 and also told me that he'd made a mistake and the training with Brent wasn't available unless I paid an extra $1000 and upgraded to the 12-month program. He also said I could take the training from a different instructor.

I told him that we had agreed that I would take the 6-month program with Brent and I was not interested in anything else. He said he'd made a mistake and would refund my money. He asked me to sleep on it. I told him I would likely take him up on the offer to refund my money but would sleep on it. I asked him to have the trainer, Brent, call me directly to discuss letting me in his class.

On 3/31/03 I contacted the VP, Shane Rawlings, and the co-founder/CEO, Chad Stubbs, (I had left a message for the trainer the prior day through the sales rep). None of them responded.

On 4/2/04 I call the sales rep and leave a message for him and tell I will take his offer of the refund.

On 4/6/04 I also sent the materials back and the company accepted them on 4/08/04.

On 4/8/04 Scott Jenson, the reference for the company, tells me that sometime between 3/31/04 and 4/8/04, Terry Austin, the sales rep, had told him that the head of their office (Chris Cannon) had approved my refund.

On 4/8/04, Kim French, Customer Service, calls and tells me the company will not refund my money. I tell her that the company misrepresented their services and breached the contract by not giving me the training they had promised. I also tell her that I was promised a refund. She insists that the company will not refund my money.

I try to find out what options I have if I cannot get my money back and ask about various training possibilities. She then offers me training with other trainers or with Brent when he is available (May 202 months after I signed up for the training).

On 4/08/04 I call the sales rep, Terry Austin, again and ask him what is going on. I ask him where is my refund/credit and why is the person in customer service calling me and telling me that I will not get the refund? I tell him again that I want a refund/credit that he offered on 3/30/04.

At this point, Vision Investing Group still refuses to refund my money or credit my account. They insist that I take the training. They originally promised their trainer Brent on or around 4/1/04. Then they said he wasn't available unless I paid an additional $1000. When they decided they had made a mistake, they promised to refund my money. They then reneged on that promise too. Vision Investing Group misrepresented their services to me, breached the contract and failed to perform.

To Whom It May Concern;

I am writing concerning the complaint filed by Becky Amble. Becky Amble enrolled in our executive mentoring coaching classes for the total amount of $4545.00 on March 10, 2004. The customer entered into a verbal agreement with our company and signed an agreement stating You, the buyer, may cancel this transaction at any time prior to midnight on the third business day after the date of this transaction or receipt of the materials, whicever is later. If you choose to exercise this right, you must contact Kim French in customer service to receive the cancellation procedures you will need to follow. You will be charged a non-refundable $45.00 shipping fee. Because the information included in the course is proprietary and confidential, no refunds will be permitted for any reason after your 3-day right to rescind.

Becky Amble did not request to cancel until after her 3 day right to rescind. She was not at any point advised that services were not available. Becky had requested to be coached by a specific mentor who does not have an opening in a class until May 20, 2004. Becky was offered this class as well as earlier classes by two other coaches. Becky has been told by our customer services representatives that she does not qualify for a refund.

At no point was a refund authorized for the customer Becky Amble. She has been advised of this on several occasions. We are not in breach of contract as it does not state anywhere in the customer's contract that she would be coached by Brent Garrison on April 1, 2004. She has been offered classes with Brent Garrison on other dates as well as classes with other coaches that she has refused.

Available is a copy of the executive mentoring agreement signed by Becky Amble stating that she has only a 3 day right to rescind and a copy of the email sent to the customer advising her that there are classes available and how to reach us for her to be scheduled, all of which has been conveyed to her over the phone.

Vision Investing Group charged me $4545 for the training that they later said was not available. The efforts to collect my refund has been going on for five months since 4/2/04 when I requested the refund. The company promised the refund due to their not providing the training they had earlier agreed to provide. The company has been totally inflexible in honoring their promise to refund my money when the training they promised was not available. They keep saying there is no way they will refund the money as they had promised. I have incurred the following expenses in working on getting my money back from them.
