First of all I cannot believe I haven't found any Class Action Lawsuits against Vivint / APX, I see many complaints but no actual claims at this time.

I did enjoye the services of Vivint which was APX two years ago during my initial contract signing, upon my 2 year contract ending just a month ago I decided I couldn't effort the luxury of such a service so I made sure to call the monitoring company 6 months in advance stating I wanted to cancel my account, their answer was you must wait before cancelling, later I found that I had a 30 day window of time to cancel before the account would automatically turn into another 1 year contract . I missed my window of cancellation by about 10 days, they're answer was sorry didn't you read the contract we cannot change the renewal process.

I figure I will File a Class Action Lawsuit against Vivint because I found it virtually impossible to pinpoint the specific time frame accepted to cancel my account. They will not work with me what so ever.

The only way I can be removed from the ongoing contract is to be sent to collections upon a delinquency of payment , I have been informed by vivint that I am still obligated to pay for the renewed year term regardless.

Enough said on this note....If you wish to be included within this Class Action Lawsuit feel free to email me at (((ROR redacted))) and subject the email something like C.A.L or Lawsuit. When I file the claim I will go back through the emails and send you the link where you can add yourself onto the claim.

My argument is going to be entrapment, the inability to close an account because of a specific window of time for the company to receive and acknowledge a hand written cancellation to be considered as closure.

Vivint informed me that they have the ability to accept a cancellation under certain circumstances although,  it sounded like it had to be something very serious like being in a coma or becoming prosecuted.  It shouldn't be such a drastic measure to simply say I want out ....

I have called now three times to cancel my service in which my husband had set up, He passed away and i can not afford to keep it. They will not let me cancel and told me to find someone to take over the service or pay the remaining 2 years to cancel. that is the only way. Well my husband died and i cant afford to pay off the 2 years if i cant evan pay the monthly payment so that is out. but what i dont understand is my husband is the main on the account, so i can not change anything unless i send his death cert to them, but if he is the main member and died than i should be able to cancel his account. If nyone is filing anything please contact me i will gladly file along with you i feellike i am being taking advantage of and i do not want this service.my contact is lou_linda317@hotmail.com

I am currently indisput with Vivint Alarm, which was Formally Apex when I signed my 3 year contract.  I had no problem what so ever with their services.  I fullfilled my 3 year contract with them paying my 49.00 a month monitoring fee.  I knew my contract was coming to an end and was anticipating canceling with the company.  I could no longer afford their services due to my hours being cut back on my job.  I called to cancel one day after my contract was expired and was informed that  I was auto renwed for one year.  That I had to cancel within thirty days of my contract expiring. And that my only alternative was  to find someone else to take over my contract or pay for one more full year of service to get out of my service with them.  My wife pulled my orriginal contract with APex, and it does indeed say that If you do not cancel withing thirty days of your contract experation date it would be automatically renewed for one more year.  Now it may say that in the contract, and I guess stupid me for not remembering that threee years latter.  But is that a really good business practice.  So now Vivint has an unhappy customer on their hands.  I have reported them to the Better Busines Bureau.  They have 1300 complaints over the past three years.  Today is their final day to respond.  Also I am getting ready to report them to the Ohio Attorney Generals Office, where there are already complaints against them.  No reputable company would do that to a person.  I can understand If I tried to get out of my contract early, but I didn't, I fullfilled my obligation.  I can't believe that there hasn't been a class action lawsuit against them.  Also just a month ago there was an article in the local newspaper.  Their reps are still pushy and getting complaints against them.

I also have the Vivint Security system in my home. I feel as though my husband and I were ripped off! None of the "fine print" was explained to us. We were very mislead! They won't let me cancel my contract which was never explained either. They are scam artists in my opinion. I would be part of a class action lawsuit if it were to come about!

I just realized we are not allowed to post emails for follow up...

Well...in the event you feel as though you've been or are being taken advantage of by the security monitoring company Vivint, Just type in Class Action Lawsuit Vivint and I'm sure one of my posts will become searchable for you to interact on.

I figure while I am paying into a years worth of their service without my consent that I'll have plenty of time to work on this Class Action suit. I will post the Information either here or wherever my freedom of information can be noted.

Approximately 1 year from today is about how long this effort will last on my part, meaning around July 20 2012 is as far as I'm willing to dedicate toward a change in Vivint's renewal policy protocol.

I will file this claim upon the knowledge of other known customers wishing to be added to such a Class Action against Vivint for similar or common contractual discrepancies.

May justice be served on our behalf ...
