I worked in the Deli at Edinboro Wal Mart last year 2002. I first got hurt there last May, I almost cut off a finger on the meat slicer. I was never trained to operate the meat slicer to start with!! And when I returned after having my finger cauterized, (burnted shut), because I sliced a hunk of flesh away, could not stitch, they expected me to just to continue do my job. They tried to make me scrub, get my hand wet , etc.
I had to remind them that I could not do those duties until the doctor says so.

Meanwhile a few weeks went by, the floor in the deli was very slippery from a grease coating on the floors all the time! Even with rubber bottom safety shoe, it was very slippery! I asked the management to please do something about the floor! Put runners down or something! Nothing was done! I went to higher management to no avail! They Do Not Care!!

The night shift did not have time to clean the floor right, because the management would not give or pay for extra time to clean things up. They expected everyone to work right up to the time that they were scheduled and not let the employees close own the deli in time to clean.

Nevertheless, I slipped and twisted my foot and popped my right knee. I had to go to the emergency room and then to their company doctors. I had a leg splint and on crutches, and in bad pain! The company doctor wrote on my excuse to not do anything. I faxed up the excuse and called to see what to do. I was told by the shift coordinator to come to work, do not take any pain killers and drive 20 miles to work! I told her that my driver's leg is the one that is hurt.

She said to me to take the splint off and drive over anyway. My husband was working at the time and I had no one to take me to work! I had July 3rd and 4th off at the time, I had plans with my family, weeks in advance to celebrate my birthday and the fourth. I told her that I can't change my plans this late and cancel. She kept telling me to not take any pain medicine and drive over and she also said that I had not to been there at
Wal Mart to request days off! This is after my deli manager gave me the days off and was on the schedule! I lost my temper over the phone, I told her to kiss my a*s and I did not need this frigin Job and hung up on her!

A week later when I had my Husband drive me over to pick up my check, they made me wait at least a half hour, a assistant store manager came out in lay away in front of customers, and wanted me to sign a statement saying that I told the coordinator to kiss my a*s and I did not need this frigin job! I refused to sign anything and stated to the girl that I have the right of freedom of speech! I was not clocked in and it was stated over my home telephone! She stated that the coordinator was my supervisor and I stated that she was not my direct supervisor! And told her to give me my check, which she did. The assistant said that she would see to it that I would never work at any Wal Mart or it affiliates again!

Later on even though I reported an accident and while I was still employed at the time their workman's compansation would not pay any of the previous bills, not even their company doctors, that they sent me to.
Wal Mart is for the GOD ALL MIGHTY DOLLAR and they do not care about their employees at all!

Tell them they had the chance to resolve this when you sent them the first registered letter

Valerie,

I would get on the phone with your nearest and dearest Workman's Comp Attorney and have a consultation with them. First, I would compose a letter to the General Manager of the store you worked in, stating the obvious OSHA violations, and ask them what they are going to do to resolve this situation, asking for response within 10 days time. Send the letter registered, so that you receive the return receipt showing they signed for it.

If they do not respond withing that time frame, send another letter, stating that theit obvious refusal to conduct themselves in a proper and professional fashion is leading you to take steps to ensure your rights are not violated any further, send this registered as well.

After you send this out, contact the Board of Health, and file a complaint with them regarding the unsanitary working conditions you had to deal with. Then, contact the Labor Board, filing a complaint, as well as the OSHA department. Believe me, when OSHA goes in to check their working environment and fining them for non-compliance, WalMart will be trying to contact you. Under no circumstances what-so-ever let them talk you out of proceeding with your Workman's compa claim. Tell them they had the chance to resolve this when you sent them the first registered letter, and chose not to do the right thing, so they forced your hand into calling your attorney, so they now have to contact said attorney.

Good Luck and keep us posted.
